The Scottish Ministers, in exercise of the powers conferred by section 36 of the Building (Scotland) Act 2003(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Building (Forms) (Scotland) Amendment Regulations 2007 and shall come into force on 1st May 2007.
2. In the Schedule to the Building (Forms) (Scotland) Regulations 2005(2)–
(a)(i)in the fifth paragraph of the declaration in Form 5; and
(ii)in the third paragraph of the declaration in Form 6
for “[and where this submission is for a dwelling]” substitute “[and when the provisions of building regulations apply]”; and
(b)for the sixth paragraph of the declaration in Form 5 and the fourth paragraph of the declaration in Form 6 substitute in each case “I enclose a copy of the energy performance certificate(s) for the building(s).”.

These Regulations amend the Building (Forms) (Scotland) Regulations 2005. This is in respect of the declaration in Forms 5 and 6 and is as a result of the requirements of Council Directive 2002/91/EC on the Energy Performance of Buildings (O.J. L 237, 22.9.03, p.28) which requires the production of an energy performance certificate for certain buildings.
