The Scottish Ministers, in exercise of the powers conferred on them by sections 22(4) and 51 of the Gaming Act 1968(1), and after consultation with the Gaming Board for Great Britain in accordance with section 51(2) of that Act, hereby make the following Regulations:

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Gaming Clubs (Hours) (Scotland) Regulations 2000 and shall come into force on 13th November 2000.

(2) These Regulations extend to Scotland only.

Interpretation

2.  In these Regulations–

“the Act” means the Gaming Act 1968;

“gaming” does not include gaming by means of any machine to which Part III of the Act applies.

Bingo hours

3.—(1) Subject to paragraphs (2) and (3) below, no gaming shall take place on bingo club premises except–

(a)between the hours of ten in the morning and midnight on a Saturday;

(b)between the hours of two in the afternoon and eleven in the evening on a Sunday; and

(c)between the hours of ten in the morning and eleven in the evening on any other day.

(2) Paragraph (1) above shall not have effect in respect of New Year’s Eve and on that day no gaming shall take place on bingo club premises except–

(a)if that day is a Sunday, between the hours of two in the afternoon and eleven in the evening; and

(b)if it is any other day, between the hours of noon and midnight.

(3) This regulation is without prejudice to any restrictions imposed in exercise of the powers in Schedule 2 to the Act (powers of licensing authority).

General gaming hours

4.—(1) No gaming shall take place on any premises (not being bingo club premises) in respect of which a licence under the Act is for the time being in force on any day, except a Sunday, between the hours of six in the morning and two in the afternoon.

(2) This regulation is without prejudice to any restrictions imposed in exercise of the powers in Schedule 2 to the Act (powers of licensing authorities).

Revocations

5.  Regulations 3 and 4 of the Gaming Clubs (Hours and Charges) (Scotland) Regulations 1984(2) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations extend the permitted hours for gaming on premises other than bingo club premises so that gaming may take place on any day, except a Sunday, from two p.m. until six a.m.instead of until four a.m. As a consequence of this the existing provisions in regulation 4 of the Gaming Clubs (Hours and Charges) (Scotland) Regulations 1984 (“the 1984 Regulations”) are revoked.

The opportunity has also been taken to consolidate in these Regulations the existing provisions in regulation 3 of the 1984 Regulations, which are concerned with the permitted hours for gaming on bingo club premises in Scotland. These hours are unchanged. As a consequence of this regulation 3 of the 1984 Regulations has been revoked.
