Citation commencement and interpretation

1.—(1) These Regulations may be cited as the Smoke Control Areas (Exempted Fireplaces) (Amendment No.2) Regulations (Northern Ireland) 2015 and come into operation on 31st January 2016.

(2) In these Regulations, “the Principal Regulations” mean the Smoke Control Areas (Exempted Fireplaces) (No.2) Regulations (Northern Ireland) 2013(1).

Amendments to the Principal Regulations

2.—(1) The Schedule to the Principal Regulations is amended in accordance with paragraphs (2) to (5).

(2) The classes of fireplace described in the first column under the heading “(1) Class of fireplace” beginning with the words—

(a)“Rais Juno”;

(b)“RAIS VIVA 98”;

(c)“Sherborne SE NS-3C, Chesham SE NS-3B, Burford SE NS-3A”; and

(d)“Vista Magnifico SE NS-1 and Vista Perfetto SE NS-2”;

and the respective conditions set out in the second column under the heading “(2) Conditions” are omitted.

(3) In the class of fireplace described in the first column under the heading “(1) Class of fireplace” beginning with the word—

“Senza”,

  • for the words “Senza UK w/o sideglass and Senza UK w/ sideglass”, substitute the words “Senza UK with sideglass and Senza UK without sideglass”.

(4) In the classes of fireplace described in the first column under the heading “(1) Class of fireplace” beginning with the words—

(a)“Newbourne 40 and Newbourne 50 Freestanding stoves”;

(b)“Newbourne 40 inset stove”;

(c)“Pevex 60 convector stove”;

(d)“Pevex Bohemia X 30, X 40, X 40 Cube, X 50 and X 60 multi-fuel stoves”;

(e)“Pevex Bohemia X 40 Inset multi-fuel appliance”;

(f)“Pevex Serenity 40D inset multi-fuel appliance”;

(g)“Serenity 40 FS, Serenity 40 LS, Serenity 40 FW stoves”;

(h)“Serenity 50FS, Serenity 50LS, Serenity 50FW and Serenity 50 Ped stoves”; and

(i)“Serenity 50 Inset stove”,

for each time that they appear, for the address of the manufacturer (“Pevex Enterprises Ltd”), substitute “Unit MP7, Kirrawah Business Park, Newbourne Road, Nr Woodbridge, IP12 4PR”.

(5) At the appropriate places in the Schedule, insert the classes of fireplace and the respective conditions set out in the Schedule to these Regulations.
