The Police (Appeals, Conduct and Unsatisfactory Performance and Attendance) (Amendment) Regulations (Northern Ireland) 2015

The Department of Justice makes the following Regulations in exercise of the powers conferred by sections 25 and 26 of the Police (Northern Ireland) Act 1998(1). Those powers are now vested in the Department(2).

In accordance with sections 25(8) and 26(6) of that Act the Department has consulted the Board and the Police Association.

Citation and commencement

1.  These Regulations may be cited as the Police (Appeals, Conduct and Unsatisfactory Performance and Attendance) (Amendment) Regulations (Northern Ireland) 2015 and shall come into operation on 30th November 2015.

Amendment of the Royal Ulster Constabulary (Appeals) Regulations 2000

2.  For the definition of “member” in regulation 3(1) of the Royal Ulster Constabulary (Appeals) Regulations 2000(3) substitute—

“member” means a member of the Police Service of Northern Ireland; or a member of the Police Service of Northern Ireland Reserve;.

3.  For the definition of “member” in regulation 4 of the Royal Ulster Constabulary (Conduct) Regulations 2000(4) substitute—

“member” means a member of the Police Service of Northern Ireland; or a member of the Police Service of Northern Ireland Reserve;.

Amendment of the Police (Unsatisfactory Performance and Attendance) Regulations (Northern Ireland) 2010

4.  For the definition of “member” in regulation 3(1) of the Police (Unsatisfactory Performance and Attendance) Regulations (Northern Ireland) 2010(5) substitute—

“member” means a member of the Police Service of Northern Ireland; or a member of the Police Service of Northern Ireland Reserve;.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the definitions of “member” in the Royal Ulster Constabulary (Appeals) Regulations 2000, the Royal Ulster Constabulary (Conduct) Regulations 2000 and the Police (Unsatisfactory Performance and Attendance) Regulations (Northern Ireland) 2010.

1998 c.32. Relevant amendments to sections 25 and 26 were made by section 78(1) of and paragraph 23 of Schedule 6 to the Police (Northern Ireland) Act 2000 and section 134 of the Anti-social Behaviour, Crime and Policing Act 2014.

Article 5 of and paragraphs 9 and 10 of Schedule 3 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010/976) transferred the regulation making powers of the Secretary of State to the Department of Justice.
