The Department of Agriculture and Rural Development(1), in exercise of the powers conferred on it by Article 3 of the Agriculture (Conservation Grants) (Northern Ireland) Order 1995(2), and of every other power enabling it in that behalf, and being a Department designated(3) for the purposes of section 2(2) of the European Communities Act 1972(4) in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, and with the consent of the Department of Finance and Personnel, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Countryside Management (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 3rd July 2006.
(2) In these Regulations—
“the principal Regulations” means the Countryside Management Regulations (Northern Ireland) 2005(5).
2.—(1) In Schedule 4 to the principal Regulations (Management Activities (Optional Habitats)), after paragraph 7,—
(a)in column 1 there is inserted—
“8. In relation to indigenous rare breeds – breeding of Irish Moiled Cattle”
(b)in column 2 there is inserted—
“£125 per female animal or bull kept for a full 12 months.”
(2) In Schedule 6 to the principal Regulations (Interpretation of Schedules), after the definition of “heritage feature”, there is inserted—
““indigenous rare breeds” means domestic livestock breeds indigenous to Northern Ireland;”
3. Regulation 2 shall not apply in a case where payment has been approved by the Department for the purposes of a grant under regulation 3 of the principal Regulations before the coming into operation of these Regulations.

These Regulations amend the Countryside Management Regulations (Northern Ireland) 2005 (“the principal Regulations”) by providing for payment of a grant in respect of breeding indigenous rare breeds, specifically the breeding of Irish Moiled Cattle (regulation 2).
A transitional provision has been included for applications approved by the Department of Agriculture and Rural Development before the coming into operation of these Regulations (regulation 3).
