The Department of Health, Social Services and Public Safety, in exercise of the powers conferred on it by Articles 3(2) and 48 of, and paragraph 16(3) of Schedule 1 to, the Health and Personal Social Services (Quality, Improvement and Regulation) (Northern Ireland) Order 2003(1) and of all other powers enabling it in that behalf, hereby makes the following Order:
1.—(1) These regulations may be cited as the Regulation and Improvement Authority (Consultation on Transfer of Staff) Regulations (Northern Ireland) 2005 and shall come into operation on 17th February 2005.
(2) In this Order –
“the Order” means the Health and Personal Social Services (Quality, Improvement and Regulation) (Northern Ireland) Order 2003;
“scheme” means a scheme made by order under paragraph 16(1) of Schedule 1 to the Order.

2. The requirements prescribed for the purposes of paragraph 16(3) of Schedule 1 to the Order (requirements about consultation to be complied with before a scheme is made by order by the Department) are that before a scheme is made by the Department, each Health and Social Services Board shall consult –
(a)the [F1RQIA] ;
(b)every professional body or trade union known to the Health and Social Services Board as representing the interests of eligible employees; and
(c)each eligible employee.
