(1)Subject to the provisions of this Act, the Corporation may in the lines or situations shown on the deposited plans and within the limits of deviation and according to the levels shown on the deposited sections make and maintain in the city the works described in Schedule 1 to this Act, together with all necessary works and conveniences connected therewith or incidental thereto.
(2)Subject to section 5 of the [1984 c. 12.] Telecommunications Act 1984, the Corporation may install and maintain telecommunication apparatus and run telecommunication systems (such apparatus and systems having the meanings given by that Act, including the extended definition of telecommunication apparatus in Schedule 2 thereto) on or over land, whether or not a street, for the purpose of telecommunication or of electrical communication between any place and any part of the works or between different parts of the works.
(3)The Corporation may within the limits of deviation, including the vertical limits prescribed by section 8 (Power to deviate) of this Act, alter, replace or re-lay any of the works described in Schedule 1 to this Act and any works authorised by section 7 (Further works and powers) of this Act.
(4)Section 109 of the [1991 c. 59.] Land Drainage Act 1991 shall not apply to the construction of the works.
(5)Section 9 of the [1975 c. 51.] Salmon and Freshwater Fisheries Act 1975 shall apply to the making and maintenance of the fish pass comprised in Work No. 1 as it applies to the making and maintenance of a fish pass made pursuant to a notice under subsection (1) of that section.
