Avon Weir Act 1992

1992 CHAPTER v

An Act to authorise the Bristol Development Corporation to construct a weir in and across the river Avon (Bristol) and to execute other works; to authorise the Corporation to acquire lands; to provide for the regulation, control and development of part of the river Avon and adjacent land and waterways for purposes including amenity and recreation; to confer further powers on the Corporation; and for other purposes.

[16th March 1992]

(1)Under the [1980 c. 65.] Local Government, Planning and Land Act 1980 the Bristol Development Corporation (in this Act called “the Corporation”) was established by the [S.I. 1989/91.] Bristol Development Corporation (Area and Constitution) Order 1988 (as amended by the [S.I. 1989/92.] Bristol Development Corporation (Area and Constitution) (Amendment) Order 1988) as the urban development corporation for an area of about 360 hectares in the county of Avon for the purpose of securing the regeneration of its area:

(2)It is the view of the Corporation that the works authorised and the powers conferred by this Act will advance the securing of such regeneration:

(3)It is accordingly expedient that the Corporation should be empowered to construct, maintain and operate a weir and other works in and across the river Avon and to provide the further works authorised by this Act, and to acquire lands therefor, so as to secure the regeneration of its area by means including the development and improvement of the amenities of the locality of the river Avon and of the lands adjacent thereto:

(4)In order to assist such regeneration it is expedient that additional powers should be conferred on the Corporation for the compulsory acquisition of land:

(5)It is expedient that provision should be made for the maintenance of the level of the river Avon upstream of the weir and for the regulation, control and development of the river and the lands and waterways adjacent to the river:

(6)It is expedient that the Corporation should be authorised to construct the other works authorised by this Act:

(7)It is expedient that the other provisions contained in this Act be enacted:

(8)The objects of this Act cannot be effected without the authority of Parliament:

(9)Plans and sections showing the lines, situations and the levels of the works authorised by this Act, and a book of reference to such plans containing the names of the owners and lessees, or reputed owners and lessees, and of the occupiers of the lands which may be acquired or used compulsorily under the powers of this Act, have been deposited in the office of the Clerk of the Parliaments and in the Private Bill Office, House of Commons, and with the proper officer of the Avon County Council, which plans, sections and book of reference are in this Act respectively referred to as the deposited plans, the deposited sections and the deposited book of reference:

May it therefore please Your Majesty that it may be enacted, and be it enacted, by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—
