The Scottish Ministers make the following Regulations in exercise of the powers conferred by paragraph 1(1) and (3) of schedule 2, and paragraph 21(b) of schedule 7 of the European Union (Withdrawal) Act 2018(1) and all other powers enabling them to do so.
There has been consultation as required by Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(2).
1. These Regulations may be cited as the Food, Natural Mineral Water, Spring Water and Bottled Drinking Water (EU Exit) (Scotland) (Amendment) Amendment Regulations 2021, and come into force on 21 March 2021.
2.—(1) The Food, Natural Mineral Water, Spring Water and Bottled Drinking Water (EU Exit) (Scotland) (Amendment) Regulations 2021(3), are amended as follows.
(2) In regulation 1(4) (citation and commencement), for “15 April 2021” substitute “27 May 2021”.
(3) In regulation 3(2) (amendment of the Food Information (Scotland) Regulations 2014) in the new regulation 10(B)(1)(a) to be inserted by that regulation for “15 April 2021” substitute “27 May 2021”.
(4) In regulation 4(2) (amendment of the Country of Origin of Certain Meats (Scotland) Regulations 2016) in the new regulation 8(1)(a) to be inserted by that regulation for “15 April 2021” substitute “27 May 2021”.

These Regulations make amendments to domestic food labelling legislation to address matters arising from the withdrawal of the UK from the European Union.
Regulation 2(2) amends the Food, Natural Mineral Water, Spring Water and Bottled Drinking Water (EU Exit) (Scotland) (Amendment) Regulations 2021 (“the 2021 Regulations”) to amend the commencement date for regulations 3 and 4 of those Regulations from 15 April 2021 to 27 May 2021.
Regulation 2(3) amends regulation 3 of the 2021 Regulations to change the start date of the transitional period that regulation 3 of the 2021 Regulations inserts into the Food (Information (Scotland) Regulations 2014 from 15 April 2021 to 27 May 2021.
Regulation 2(4) amends regulation 4 of the 2021 Regulations to change the start date of the transitional period that regulation 4 of the 2021 Regulations inserts into the Country of Origin of Certain Meats (Scotland) Regulations 2016 from 15 April 2021 to 27 May 2021.
2018 c.16. There are amendments to paragraph 1 of schedule 2 not relevant to these Regulations. Paragraph 21 of schedule 7 was amended by paragraph 53 of Part 2 of schedule 5 of the European Union (Withdrawal Agreement) Act 2020 (c.1).
EUR 178/2002. A consultation was carried out for the revision of food law contained in S.S.I. 2021/66, which applies to the revision of food law contained in these Regulations.
