The Scottish Ministers, in exercise of the powers conferred by section 7(1) and (2) of the Primary Medical Services (Scotland) Act 2004(1) and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the General Medical Services and Section 17C Agreements (Transitional and Other Ancillary Provisions) (Scotland) Amendment Order 2004 and shall come into force on 30th September 2004.
2. In article 101(4) (transitory modification of the National Health Service (Vocational Training for General Medical Practice) (Scotland) Regulations 1998) of the General Medical Services and Section 17C Agreements (Transitional and Other Ancillary Provisions) (Scotland) Order 2004(2) for “(iii) maternity medical services only.” substitute–
“(iii)maternity medical services only;
(iv)minor surgery services only; or
(v)any combination of the services mentioned in paragraphs (i) to (iv) above;”.

This Order amends the General Medical Services and Section 17C Agreements (Transitional and Other Ancillary Provisions) (Scotland) Order 2004 (“the principal Order”), which sets out transitional and ancillary provision arising for the purposes of, or in consequence of, the Primary Medical Services (Scotland) Act 2004.
This Order corrects an error in the provisions of the principal Order relating to a transitory modification of the National Health Service (Vocational Training for General Medical Practice) (Scotland) Regulations 1998 (“the 1998 Regulations”). The provision relates to medical practitioners who on 31st December 1994 provided limited types of general medical services. This Order makes clear that those medical practitioners who provided minor surgery services only, or a combination of limited types of general medical services are exempt from the need to have prescribed experience under the 1998 Regulations.
