The Budget (Scotland) Act 2003 Amendment Order 2003

The Scottish Ministers, in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2003(1) and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 7(2) of that Act, been laid before, and approved by resolution of, the Scottish Parliament:

Citation and commencement

1.  This Order may be cited as the Budget (Scotland) Act 2003 Amendment Order 2003 and shall come into force on the day following that on which it is made.

Amendment of the Budget (Scotland) Act 2003

2.—(1) The Budget (Scotland) Act 2003 is amended in accordance with the following paragraphs.

(2) In section 3(d) (overall cash authorisations in relation to the Scottish Parliamentary Corporate Body), for “£108,753,000” substitute “£202,930,000”.

(3) In schedule 1–

(a) in column 2 as regards item 1, for “£1,036,066,000” substitute “£1,033,353,000”;

(b) in column 2 as regards item 2 for “£2,386,164,000” substitute “£2,151,214,000”;

(c) in column 2 as regards item 3 for “£590,831,000” substitute “£590,602,000”;

(d) in column 2 as regards item 4 for “£2,334,678,000” substitute “£2,334,553,000”;

(e) in column 2 as regards item 5 for “£6,733,128,000” substitute “£6,666,228,000”;

(f) in column 2 as regards item 6 for “£1,181,945,000” substitute “£1,161,964,000”;

(g) in column 2 as regards item 7 for “£230,302,000” substitute “£226,966,000”;

(h) in column 2 as regards item 8 for “£8,137,000” substitute “£7,942,000”;

(i) in column 2 as regards item 9 for “£8,541,000” substitute “£8,286,000”; and

(j) in column 2 as regards item 11 for “£87,100,000” substitute “£86,850,000”.

(4) In schedule 3–

(a) in column 2 as regards item 1 for “£88,752,000” substitute “£73,104,000”;

(b) in column 2 as regards item 3 for “£108,753,000” substitute “£185,834,000”; and

(c) in column 2 as regards item 4 for “£6,224,000” substitute “£6,199,000”.

Explanatory Note

(This Note is not part of the Order)

This Order amends the Budget (Scotland) Act 2003 (“the Act”), which makes provision, for Financial Year 2003/04, for the use of resources by the Scottish Administration and certain bodies whose expenditure is payable out of the Scottish Consolidated Fund, for authorising the use of resources, and for limits on the capital expenditure of and borrowing of local authorities and certain other public bodies. In particular, the Order amends the Act so as to–

(a) alter for the purposes of section 4(2) of the Public Finance and Accountability (Scotland) Act 2000, the overall cash authorisations for Financial Year 2003/04 as regards the Scottish Parliamentary Corporate Body;

(b) re-state the amounts of resources other than accruing resources that may be used for purposes 1 to 9 and 11 set out in column 1 of schedule 1 to the Act; and

(c) re-state in schedule 3 to the Act the amount of resources other than accruing resources which the first, third and fourth named directly funded bodies referred to therein may use for the purposes specified therein.
