Coming into force in accordance with article 1(2)
The Scottish Ministers, in exercise of the powers conferred by article 30(1) of the Foot and Mouth Disease Order 1983(1), and of all other powers enabling them in that behalf, hereby make the following Order:
1.—(1) This Order may be cited as the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Amendment (No. 2) Order 2001.
(2) For the purposes of article 2, this Order shall come into force at 7.00 pm on 12th April 2001 and for the purposes of article 3, this Order shall come into force on 16th April 2001.
2. In Schedule 1 to the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001(2)–
(a)for “(specify number of days, which shall be a number of days not more than 5)”, substitute “(specify number of days, which shall be a number of days not more than 7)”; and
(b)in paragraph 2 of the “Conditions of Licence”, for “5 days”, substitute “7 days”.
3. In article 4(9B) of the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001(3), there is inserted at the end–
“(r)the area of the City of Edinburgh Council;
(s)the area of the City of Glasgow Council”.

This Order amends the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001.
It amends the maximum number of days within which licensed movement to slaughter must be completed from 5 days to 7 (article 2).
It also amends the ban on hunting and stalking for deer, by adding the areas of the Edinburgh and Glasgow Councils to the permitted areas where, in certain circumstances, exceptions are allowed to the ban on hunting or stalking certain types of deer (article 3).
S.I. 1983/1950, as amended by S.I. 1993/3119, S.I. 1995/2922 and, as regards Scotland, by S.S.I. 2001/52, 55 and 101. See article 3(1) for the definition of “the Minister”. The functions of “the Minister”, so far as exercisable in relation to Scotland, were transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (c. 46).
