Defnyddir y term darpariaeth i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – megis Rhan, Pennod neu adran. Mae fersiwn o ddarpariaeth yn rhagolygol naill ai:

  1. os nad yw'r ddarpariaeth (Rhan, Pennod neu adran) erioed wedi dod i rym neu;
  2. pan fo testun y ddarpariaeth wedi'i newid, ond nad oes dyddiad wedi'i bennu eto gan y person neu'r corff priodol i'r newidiadau hynny i ddod i rym.

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. (1)Pan fo adeilad categori 1 neu adeilad categori 2 wedi ei feddiannu, rhaid i bob person atebol ar gyfer yr adeilad sicrhau bod y risgiau diogelwch strwythurol sy’n ymwneud â’r rhan o’r adeilad y mae’r person yn gyfrifol amdani yn cael eu hasesu yn unol â’r adran hon ac unrhyw reoliadau a wneir oddi tani.

(2)Cyfeirir at asesiad o dan is-adran (1) yn y Ddeddf hon fel “asesiad risg strwythurol”.

(3)Rhaid i asesiad risg strwythurol ar gyfer rhan o adeilad—

(a)cael ei wneud gan unigolyn neu gorff sy’n meddu ar arbenigedd neu brofiad digonol i asesu’r risgiau diogelwch strwythurol mewn perthynas â’r rhan honno, a

(b)bod yn addas ac yn ddigonol i alluogi’r person atebol sy’n gyfrifol am y rhan honno (neu unrhyw berson arall sy’n cael ei drin fel person atebol o’r fath yn rhinwedd adran 36) i gydymffurfio ag adran 35 (rheoli risgiau diogelwch strwythurol).

(4)Rhaid i asesiad risg strwythurol cyntaf person atebol gael ei wneud cyn gynted â phosibl ar ôl i’r diweddaraf o’r digwyddiadau a ganlyn ddigwydd—

(a)bod yr adeilad yn cael ei feddiannu;

(b)bod y person yn dod yn berson atebol ar gyfer yr adeilad;

(c)bod yr adran hon yn dod i rym.

(5)Rhaid gwneud asesiadau risg strwythurol pellach—

(a)ar ysbeidiau rheolaidd;

(b)cyn gynted â phosibl os oes gan y person atebol reswm dros amau nad yw’r asesiad cyfredol yn addas nac yn ddigonol mwyach at y diben a grybwyllir yn is-adran (3)(b);

(c)os cyfarwyddir y person atebol i wneud hynny gan awdurdod diogelwch adeiladau yr adeilad, o fewn cyfnod a bennir yn y cyfarwyddyd.

(6)Rhaid i berson atebol sy’n gyfrifol am ran o adeilad sicrhau—

(a)y cofnodir canfyddiadau pob asesiad risg strwythurol ar gyfer y rhan honno yn ysgrifenedig, a

(b)y rhoddir copi o bob asesiad i’r prif berson atebol ar gyfer yr adeilad (pan nad y person atebol yw’r prif berson atebol).

(7)Caiff Gweinidogion Cymru drwy reoliadau—

(a)pennu gofynion y mae rhaid i unigolyn neu gorff eu bodloni er mwyn ystyried eu bod yn meddu ar arbenigedd neu brofiad digonol at ddiben gwneud asesiad risg strwythurol (gan gynnwys gofynion ar gyfer cymwysterau penodol neu ar gyfer achrediad gan‍ sefydliad penodol, neu aelodaeth o sefydliad penodol);

(b)pennu materion y mae rhaid eu hystyried fel rhan o asesiad;

(c)gwneud darpariaeth ynghylch y fethodoleg y mae rhaid ei defnyddio wrth wneud asesiad;

(d)pennu gwybodaeth y mae rhaid ei chynnwys yng nghofnod ysgrifenedig asesiad;

(e)pennu’r ysbaid hiraf y caiff person atebol ganiatáu iddo fynd heibio rhwng asesiadau.

(8)Cyn gwneud rheoliadau o dan is-adran (7), rhaid i Weinidogion Cymru ymgynghori ag—

(a)pob‍ cyngor sir a chyngor bwrdeistref sirol yng Nghymru,

(b)pob awdurdod diogelwch tân, ac

(c)unrhyw bersonau eraill y maent yn ystyried eu bod yn briodol.
