45Hawl yr Awdurdod i symud ymaith eiddo a’i waredu

(1)Caiff yr Awdurdod, at ddiben cynnal gweithrediadau neu waith adfer canlyniadol ar dir o dan adran 44, symud ymaith a gwaredu unrhyw eiddo y mae person arall yn berchen arno sydd wedi ei leoli ar y tir.
(2)Os yw’r Awdurdod yn gwaredu eiddo o dan is-adran (1) drwy ei werthu, rhaid i’r Awdurdod roi cyfrif i berchennog yr eiddo am yr enillion gwerthu.
(3)Nid yw is-adran (2) yn atal yr Awdurdod rhag—
(a)didynnu o’r enillion gwerthu unrhyw dreuliau yr eir iddynt yn rhesymol gan yr Awdurdod wrth werthu’r eiddo;
(b)gosod yr enillion gwerthu, neu unrhyw ran o’r enillion hynny, yn erbyn unrhyw swm y mae gan yr Awdurdod hawlogaeth i’w adennill oddi wrth berchennog yr eiddo o dan Bennod 3.
