23Pŵer i addasu deddfwriaeth uniongyrchol yr UE a ddargedwir sy’n ymwneud ag ymyrraeth yn y farchnad gyhoeddus a chymorth ar gyfer storio preifat LL+C

(1)Caiff Gweinidogion Cymru, drwy reoliadau, addasu deddfwriaeth uniongyrchol yr UE a ddargedwir sy’n ymwneud ag ymyrraeth yn y farchnad gyhoeddus neu gymorth ar gyfer storio preifat, i’r graddau y mae’n cael effaith o ran Cymru.
(2)Mae’r pŵer a roddir gan yr adran hon yn cynnwys pŵer i newid y cynhyrchion amaethyddol sy’n gymwys am ymyrraeth yn y farchnad gyhoeddus neu gymorth ar gyfer storio preifat.
(3)Yn yr adran hon, mae “deddfwriaeth uniongyrchol yr UE a ddargedwir sy’n ymwneud ag ymyrraeth yn y farchnad gyhoeddus neu gymorth ar gyfer storio preifat” yn cynnwys—
(a)Erthyglau 8 i 18 o’r Rheoliad CMO;
(b)Rheoliad y Cyngor (EU) Rhif 1370/2013 dyddiedig 16 Rhagfyr 2013 sy’n pennu mesurau ar bennu cymorthyddion ac ad-daliadau penodol sy’n ymwneud â chyd-drefniadaeth y marchnadoedd mewn cynhyrchion amaethyddol (i’r graddau y maent yn ymwneud ag ymyrraeth yn y farchnad gyhoeddus a chymorth ar gyfer storio preifat);
(c)Rheoliadau canlynol y Comisiwn (i’r graddau y maent yn ymwneud ag ymyrraeth yn y farchnad gyhoeddus a chymorth ar gyfer storio preifat)—
(i)Rheoliad Dirprwyedig y Comisiwn (EU) 2016/1238 dyddiedig 18 Mai 2016 sy’n ategu’r Rheoliad CMO o ran ymyrraeth gyhoeddus a chymorth ar gyfer storio preifat;
(ii)Rheoliad Gweithredu’r Comisiwn (EU) 2016/1240 dyddiedig 18 Mai 2016 sy’n gosod rheolau ar gyfer cymhwyso’r Rheoliad CMO o ran ymyrraeth gyhoeddus a chymorth ar gyfer storio preifat;
(iii)Rheoliad Dirprwyedig y Comisiwn (EU) 2017/1182 dyddiedig 20 Ebrill 2017 sy’n ategu’r Rheoliad CMO mewn perthynas â graddfeydd yr Undeb ar gyfer dosbarthiad carcasau buchol, moch a defaid ac mewn perthynas ag adrodd ar brisiau’r farchnad o ran categorïau penodol o garcasau ac anifeiliaid byw.
(4)Hyd nes y bydd unai paragraff 1 neu baragraff 2 o Atodlen 3 (diwygio Erthyglau 219, 220, 221 a 222 o’r Rheoliad CMO) mewn grym, mae unrhyw gyfeiriad yn yr adran hon at amodau eithriadol yn y farchnad sy’n destun datganiad amodau eithriadol yn y farchnad yn cynnwys cyfeiriad at amgylchiadau sy’n destun mesurau o dan unrhyw un neu ragor o’r Erthyglau hynny.
