S. 2(1) amends s. 6 of 1946 c. 20 (NI); subs. (2) substitutes s. 7 of 1946 c. 20 (NI); subs. (3)‐(5) amend ss. 8, 15(2), 16 of 1946 c. 20 (NI)

3 F1Power to seek alternative grants.N.I.

(1)Where plans and specifications of a new house have (whether before or after the passing of this Act) been approved by a [F2 district council] for the purposes of the payment of grants under Part III of the Housing (No. 2) Act (Northern Ireland), 1946 [1946 c.20] , and the person providing the house satisfies the [F2 district council] that—

(a)no grant has been paid under the said Part III in respect of that house;

(b)if such plans and specifications had been submitted to the [F2 district council] under section one of the Housing and Local Government (Miscellaneous Provisions) Act (Northern Ireland), 1946 [1946 c.4] , they would have been approved by the [F2 district council] under that section; and

(c)he has made such a letting thereof as complies with the statutory conditions set out in section two of that Act;

the [F2 district council] may make to him the like contribution as if such plans and specifications had been approved under that Act; and the provisions of that Act shall have effect accordingly.

(2)The submission of plans and specifications under the said section one shall not preclude the person providing the house from electing [F3 within such time after the house has been completed as the [F2 district council] consider reasonable in the circumstances and before he has made such a letting thereof as is mentioned in paragraph ( c) of sub-section (1) of this section] to withdraw the plans and specifications and submit them for approval under the said Part III.
