And whereas by divers Acts the Moiety or other fixed Portion of the Penalties to be thereby recovered is directed to be adjudged to the Informer, and the same has been found to encourage the corrupt Practices of Common Informers; for Prevention thereof be it enacted, That where by any Act now in force or hereafter to be passed a Moiety or other, fixed Portion of the Penalty or Penalties thereby imposed is or shall be directed to be paid to the Informer, not being the Party aggrieved, it shall be lawful for any One of the said Magistrates before whom the Conviction shall be had to adjudge that no Part or such Part only of the Penalty as he shall think fit shall be paid to the Informer.
