10(1)A hereditament is exempt to the extent that it consists of a right of fishing exercisable in a fishery regulated by an order which—
(a)is made under section 28(3) of the [1975 c. 51.] Salmon and Freshwater Fisheries Act 1975, and
(b)contains such provision as is mentioned in paragraph 1(a) of Schedule 3 to that Act (contributions imposed by water authorities).
(2)A hereditament is exempt to the extent that it consists of a right of fishing exercisable in a fishery—
(a)which is regulated by the council constituted under section 6 of the [1969 c. xxiv .] Tweed Fisheries Act 1969, and
(b)as regards which a rate or assessment is levied under section 79 of the [1857 c. cxlviii.] Tweed Fisheries Act 1857 or section 5 of the [1859 c. lxx.] Tweed Fisheries Amendment Act 1859.
