This is the original version (as it was originally enacted).
16(1)In section 17 (liability to maintain), after subsection (2) there shall be inserted the following subsection—
“(2A)Subsection (2) above shall not apply to Scotland, and in the application of subsection (1) to Scotland any reference to children shall be construed as a reference to children whether or not their parents have ever been married to one another.”
(2)In section 18 (recovery of expenditure on supplementary benefits from persons liable for maintenance), at the end there shall be inserted the following subsection—
“(9)On an application under subsection (1) above a court in Scotland may make a finding as to the parentage of a child for the purpose of establishing whether a person is, for the purposes of this Act, liable to maintain him.”.
