This Order is made in exercise of the powers conferred by section 9(7) of the Industrial Organisation and Development Act 1947(1), and now vested in the Secretary of State(2).

The Secretary of State for Business, Enterprise and Regulatory Reform has consulted the organisations appearing to the Secretary of State to be representative of substantial numbers of persons carrying on business in the wool textile industry and the organisations representative of persons employed in that industry appearing to the Secretary of State to be appropriate(3).

A draft of this instrument has been approved by a resolution of each House of Parliament pursuant to section 9(9) of that Act.

Accordingly, the Secretary of State for Business, Enterprise and Regulatory Reform makes the following Order:—

Citation, commencement, extent and cessation of charges

1.—(1) This Order may be cited as the Wool Textile Industry (Export Promotion Levy) (Revocation) Order 2008, shall extend to England and Wales and Scotland, and shall come into force on the day after it is made.

(2) The provisions of Article 6 of the Wool Textile Industry (Export Promotion Levy) Order 1970(4) shall not impose on any person any charge in respect of any period after 30th September 2008.

Revocation

2.  The Wool Textile Industry (Export Promotion Levy) Order 1970, the Wool Textile Industry (Export Promotion Levy) (Amendment) Order 1971(5) and the Wool Textile Industry (Export Promotion Levy) (Amendment) Order 1982(6) are revoked.

This Order revokes the Wool Textile Industry (Export Promotion Levy) Order 1970, the Wool Textile Industry (Export Promotion Levy) (Amendment) Order 1971 and the Wool Textile Industry (Export Promotion Levy) (Amendment) Order 1982 in relation to England and Wales and Scotland. These Orders imposed or modified levies to finance export promotion by the National Wool Textile Export Corporation in connection with the wool textile industry. The Wool Textile Industry (Export Promotion Levy) Order 1970, as amended, ceases to have effect as respects the imposition of the levy for any period after 30th September 2008.

A full regulatory impact assessment of the effect that this instrument will have on the cost to business and the voluntary sector has been placed in the libraries of both Houses of Parliament. 1947 c.40. As regards Scotland, the power was transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (c.46) but remains exercisable by the Secretary of State by virtue of section 56(1) of that Act.

S.I. 1970/1537. Section 9 of the Industrial Organisation and Development Act 1947 confers the power to make orders to revoke an order made under that section on “the authority making the original order.” By section 9(1) the “authorities” are those named in section 1(2) of the Act. The Wool Textile Industry (Export Promotion Levy) Order 1970 was made by the Minister of Technology under section 9 of the Act by virtue of the transfer of functions in the Minister of Technology Order 1969, S.I. 1969/1498 and there was a further transfer of those functions from the Minister of Technology to the Secretary of State by the Secretary of State for Trade and Industry Order 1970, S.I. 1970/1537.

Sections 1(3) and 9(8) of the Industrial Organisation and Development Act 1947 impose the obligation to consult.
