Citation, commencement and interpretation

1.—(1) This Order may be cited as the Scottish Marine Regions Order 2015 and comes into force on the day after the day on which it is made.

(2) In this Order “co-ordinate” means a co-ordinate on the Ordnance Survey of Great Britain 1936 Datum.

(3) In relation to any co-ordinates, including any list of co-ordinates, a reference to a line in this Order means—

(a)except in the case mentioned in sub-paragraph (b), a loxodromic line; and

(b)in the case of a reference to a line of shortest distance, a line of the shortest planar distance on the British National Grid Projection(1).

The Scottish marine region for the Solway

2.—(1) That part of the Scottish marine area(2), the boundaries of which are identified in paragraphs (2) to (4), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the Solway’.

(2) It is bounded to the east, south-east, south, south-west and west by the limit of the Scottish marine area between—

(a)the most north-easterly point on the landward limit of the Scottish marine area adjacent to the River Sark; and

(b)the co-ordinate 55°00′31″ north latitude, 05°32′58″ west longitude(3).

(3) It is bounded to the north-west by—

(a)firstly, a line between the co-ordinates 55°00′31″ north latitude, 05°32′58″ west longitude and 54°59′52″ north latitude, 05°02′23″ west longitude, defined by joining sequentially the following co-ordinates—

(4) It is bounded to the north and north-east by the landward limit of the Scottish marine area between—

(a)the point described in paragraph (3)(b)(ii); and

(b)the point described in paragraph (2)(a).

The Scottish marine region for the Clyde

3.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (5), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the Clyde’.

(2) It is bounded to the south by—

(a)firstly, a line between—

(i)the point on the mainland of Scotland where a line between the co-ordinates 55°00′06″ north latitude, 05°01′30″ west longitude and 54°59′52″ north latitude, 05°02′23″ west longitude intersects the landward limit of the Scottish marine area; and

(ii)the co-ordinate 54°59′52″ north latitude, 05°02′23″ west longitude; and

(b)secondly, a line between the co-ordinates 54°59′52″ north latitude, 05°02′23″ west longitude and 55°00′31″ north latitude, 05°32′58″ west longitude, defined by joining sequentially the following co-ordinates—

(4) It is bounded to the west by—

(a)firstly, a line between the co-ordinates 55°13′12″ north latitude, 05°53′33″ west longitude and 55°17′56″ north latitude, 05°47′54″ west longitude, defined by joining sequentially the following co-ordinates—

(5) It is bounded to the west, north and east by the landward limit of the Scottish marine area between—

(a)the point described in paragraph (4)(b)(ii); and

(b)the point described in paragraph (2)(a)(i).

The Scottish marine region for Argyll

4.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (6), is designated as a Scottish marine region to be known as ‘the Scottish marine region for Argyll’.

(2) It is bounded to the south by—

(a)firstly, a line between—

(i)the point on the mainland of Scotland where a line between the co-ordinates 55°18′25″ north latitude, 05°47′08″ west longitude and 55°17′56″ north latitude, 05°47′54″ west longitude intersects the landward limit of the Scottish marine area; and

(ii)the co-ordinate 55°17′56″ north latitude, 05°47′54″ west longitude; and

(b)secondly, a line between the co-ordinates 55°17′56″ north latitude, 05°47′54″ west longitude and 55°13′12″ north latitude, 05°53′33″ west longitude, defined by joining sequentially the following co-ordinates—

The Scottish marine region for the West Highlands

5.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (6), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the West Highlands’.

(2) It is bounded to the south by—

(a)firstly, a line between—

(i)the point on the mainland of Scotland where a line between the co-ordinates 56°36′49″ north latitude, 05°18′51″ west longitude and 56°37′16″ north latitude, 05°19′27″ west longitude intersects the landward limit of the Scottish marine area; and

(ii)the co-ordinate 56°37′16″ north latitude, 05°19′27″ west longitude; and

(b)secondly, a line between the co-ordinates 56°37′16″ north latitude, 05°19′27″ west longitude and 56°47′29″ north latitude, 07°01′55″ west longitude, defined by joining sequentially the following co-ordinates—

(5) It is bounded to the north-east by—

(a)firstly, a line of shortest distance between the seaward limit of the Scottish marine area and the co-ordinate 58°49′11″ north latitude, 04°59′48″ west longitude;

(b)secondly, a line between the co-ordinates 58°49′11″ north latitude, 04°59′48″ west longitude and 58°37′40″ north latitude, 05°00′05″ west longitude; and

(c)thirdly, a line between—

(i)the co-ordinate 58°37′40″ north latitude, 05°00′05″ west longitude; and

(ii)the point on the mainland of Scotland where a line between the co-ordinates 58°37′40″ north latitude, 05°00′05″ west longitude and 58°36′38″ north latitude, 04°59′26″ west longitude intersects the landward limit of the Scottish marine area.

(6) It is bounded to the east by the landward limit of the Scottish marine area between—

(a)the point described in paragraph (5)(c)(ii); and

(b)the point described in paragraph (2)(a)(i).

The Scottish marine region for the Outer Hebrides

6.—(1) Those parts of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (6), are designated as a Scottish marine region to be known as ‘the Scottish marine region for the Outer Hebrides’.

(2) It is bounded to the south by—

(a)firstly, a line between the co-ordinates 56°47′29″ north latitude, 07°01′55″ west longitude and 56°27′52″ north latitude, 07°40′34″ west longitude, defined by joining sequentially the following co-ordinates—

(5) The Scottish marine region for the Outer Hebrides includes that part of the Scottish marine area which is adjacent to the following Scottish islands—

(a)St Kilda (Hirta)(5); and

(b)St Kilda (Boreray)(6),

and bounded to the north, east, south and west by the seaward limit of the Scottish marine area.

(6) The Scottish marine region for the Outer Hebrides includes that part of the Scottish marine area which is adjacent to the following Scottish islands—

(a)Sula Sgeir(7); and

(b)North Rona(8)

and bounded to the north, east, south and west by the seaward limit of the Scottish marine area.

The Scottish marine region for the North Coast

7.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (6), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the North Coast’.

(2) It is bounded to the south by the landward limit of the Scottish marine area between—

(a)the point described in paragraph (6)(b)(ii); and

(b)the point described in paragraph (3)(a)(i).

(3) It is bounded to the west by—

(a)firstly, a line between—

(i)the point on the mainland of Scotland where a line between the co-ordinates 58°36′38″ north latitude, 04°59′26″ west longitude and 58°37′40″ north latitude, 05°00′05″ west longitude intersects the landward limit of the Scottish marine area; and

(ii)the co-ordinate 58°37′40″ north latitude, 05°00′05″ west longitude;

(b)secondly, a line between the co-ordinates 58°37′40″ north latitude, 05°00′05″ west longitude and 58°49′11″ north latitude, 04°59′48″ west longitude; and

(c)thirdly, a line of shortest distance between the co-ordinate 58°49′11″ north latitude, 04°59′48″ west longitude and the seaward limit of the Scottish marine area.

(4) It is bounded to the north by the seaward limit of the Scottish marine area between—

(a)the point it meets the line described in paragraph (3)(c); and

(b)the point it meets the line described in paragraph (5)(a).

(5) It is bounded to the north-east by—

(a)firstly, a line of shortest distance between the seaward limit of the Scottish marine area and the co-ordinate 58°48′08″ north latitude, 03°46′13″ west longitude; and

(b)secondly, a line between the co-ordinates 58°48′08″ north latitude, 03°46′13″ west longitude and 58°38′37″ north latitude, 02°57′05″ west longitude, defined by joining sequentially the following co-ordinates—

(i)the co-ordinate 58°38′38″ north latitude, 03°01′20″ west longitude; and

(ii)the point on the mainland of Scotland where a line between the co-ordinates 58°38′38″ north latitude, 03°01′20″ west longitude and 58°38′13″ north latitude, 03°03′05″ west longitude intersects the landward limit of the Scottish marine area.

The Scottish marine region for the Orkney Islands

8.—(1) Those parts of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (6), are designated as a Scottish marine region to be known as ‘the Scottish marine region for the Orkney Islands’.

(2) It is bounded to the south by—

(a)firstly, a line of shortest distance between the seaward limit of the Scottish marine area and the co-ordinate 58°38′47″ north latitude, 02°32′38″ west longitude;

(b)secondly, a line between the co-ordinates 58°38′47″ north latitude, 02°32′38″ west longitude and 58°38′37″ north latitude, 02°57′05″ west longitude;

(c)thirdly, a line between the co-ordinates 58°38′37″ north latitude, 02°57′05″ west longitude and 58°48′08″ north latitude, 03°46′13″west longitude, defined by joining sequentially the following co-ordinates—

(a)the point it meets the line described in paragraph (2)(d); and

(b)the point it meets the line described in paragraph (4)(a).

(4) It is bounded to the north-east by—

(a)firstly, a line of shortest distance between the seaward limit of the Scottish marine area and the co-ordinate 59°29′21″ north latitude, 02°02′15″ west longitude;

(b)secondly, a line between the co-ordinates 59°29′21″ north latitude, 02°02′15″ west longitude and 59°24′42″ north latitude, 01°59′19″ west longitude; and

(c)thirdly, a line of shortest distance between the co-ordinate 59°24′42″ north latitude, 01°59′19″ west longitude and the seaward limit of the Scottish marine area.

(5) It is bounded to the east by the seaward limit of the Scottish marine area between—

(a)the point it meets the line described in paragraph (4)(c); and

(b)the point it meets the line described in paragraph (2)(a).

(6) The Scottish marine region for the Orkney Islands includes that part of the Scottish marine area which is adjacent to the following Scottish islands—

(a)Sule Stack(9); and

(b)Sule Skerry(10),

and bounded to the north, east, south and west by the seaward limit of the Scottish marine area.

The Scottish marine region for the Shetland Isles

9.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) and (3), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the Shetland Isles’.

(2) It is bounded to the south west by—

(a)firstly, a line of shortest distance between the seaward limit of the Scottish marine area and the co-ordinate 59°24′42″ north latitude, 01°59′19″ west longitude;

(b)secondly, a line between the co-ordinates 59°24′42″ north latitude, 01°59′19″ west longitude and 59°29′21″ north latitude, 02°02′15″ west longitude; and

(c)thirdly, a line of shortest distance between the co-ordinate 59°29′21″ north latitude, 02°02′15″ west longitude and the seaward limit of the Scottish marine area.

(3) It is bounded to the west, north, east and south by the seaward limit of the Scottish marine area between—

(a)the point it meets the line described in paragraph (2)(c); and

(b)the point it meets the line described in paragraph (2)(a).

The Scottish marine region for the Moray Firth

10.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (5), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the Moray Firth’.

(2) It is bounded to the south and west by the landward limit of the Scottish marine area between—

(a)the point described in paragraph (5)(c)(ii); and

(b)the point described in paragraph (3)(a)(i).

(3) It is bounded to the north by—

(a)firstly, a line between—

(i)the point on the mainland of Scotland where a line between the co-ordinates 58°38′13″ north latitude, 03°03′05″ west longitude and 58°38′38″ north latitude, 03°01′20″ west longitude intersects the landward limit of the Scottish marine area; and

(ii)the co-ordinate 58°38′38″ north latitude, 03°01′20″ west longitude;

(b)secondly, a line between the co-ordinates 58°38′38″ north latitude, 03°01′20″ west longitude and 58°38′47″ north latitude, 02°32′38″ west longitude, defined by joining sequentially the following co-ordinates—

(a)firstly, a line of shortest distance between the seaward limit of the Scottish marine area and the co-ordinate 57°52′37″ north latitude, 01°55′13″ west longitude;

(b)secondly, a line between the co-ordinates 57°52′37″ north latitude, 01°55′13″ west longitude and 57°41′57″ north latitude, 02°00′09″ west longitude, defined by joining sequentially the following co-ordinates—

The Scottish marine region for the North East

11.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (5), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the North East’.

(2) It is bounded to the west by the landward limit of the Scottish marine area between—

(a)the point it meets the line described in paragraph (5)(c)(ii); and

(b)the point it meets the line described in paragraph (3)(a)(i).

(3) It is bounded to the north-west by—

(a)firstly, a line between—

(i)the point on the mainland of Scotland where a line between the co-ordinates 57°41′14″ north latitude, 02°00′58″ west longitude and 57°41′57″ north latitude, 02°00′09″ west longitude intersects the landward limit of the Scottish marine area; and

(ii)the co-ordinate 57°41′57″ north latitude, 02°00′09″ west longitude;

(b)secondly, a line between the co-ordinates 57°41′57″ north latitude, 02°00′09″ west longitude and 57°52′37″ north latitude, 01°55′13″ west longitude, defined by joining sequentially the following co-ordinates—

(a)firstly, a line of shortest distance between the seaward limit of the Scottish marine area and the co-ordinate 56°44′09″ north latitude, 01°59′07″ west longitude;

(b)secondly, a line between the co-ordinates 56°44′09″ north latitude, 01°59′07″ west longitude and 56°45′27″ north latitude, 02°25′20″ west longitude, defined by joining sequentially the following co-ordinates—

The Scottish marine region for the Forth and Tay

12.—(1) That part of the Scottish marine area, the boundaries of which are identified in paragraphs (2) to (5), is designated as a Scottish marine region to be known as ‘the Scottish marine region for the Forth and Tay’.

(2) It is bounded to the south and west by the landward limit of the Scottish marine area between—

(a)the point described in paragraph (5)(b); and

(b)the point described in paragraph (3)(a)(i).

(3) It is bounded to the north by—

(a)firstly, a line between—

(i)the point on the mainland of Scotland where a line between the co-ordinates 56°45′43″ north latitude, 02°26′21″ west longitude and 56°45′27″ north latitude, 02°25′20″ west longitude intersects the landward limit of the Scottish marine area; and

(ii)the co-ordinate 56°45′27″ north latitude, 02°25′20″ west longitude;

(b)secondly, a line between the co-ordinates 56°45′27″ north latitude, 02°25′20″ west longitude and 56°44′09″ north latitude, 01°59′07″ west longitude, defined by joining sequentially the following co-ordinates—

(5) It is bounded to the south-east by the limit of the Scottish marine area between—

(a)the co-ordinate 55°55′01″ north latitude, 01°43′32″ west longitude; and

(b)the most southerly point on its landward limit on the east coast of Scotland.
