The Scottish Ministers make the following Order in exercise of the powers conferred by section 11(1) of the Aquaculture and Fisheries (Scotland) Act 2013(1) and all other powers enabling them to do so.
1. This Order may be cited as the Aquaculture and Fisheries (Scotland) Act 2013 (Specification of Commercially Damaging Species) Order 2014 and comes into force on 23rd August 2014.
2. For the purposes of Chapter 3 of Part 1 of the Aquaculture and Fisheries (Scotland) Act 2013 Mytilus trossulus(2) is specified as a commercially damaging species.

This Order specifies Mytilus trossulus, a form of mussel, as a commercially damaging species for the purposes of chapter 3 of Part 1 of the Aquaculture and Fisheries (Scotland) Act 2013 (“the Act”). Chapter 3 of Part 1 of the Act makes provision concerning the notification and control of such species. Failure to notify the presence of a commercially damaging species in accordance with section 15(1) or (2) of the Act is an offence.
A Business and Regulatory Impact Assessment has been prepared and a copy is available from Marine Scotland, Victoria Quay, Leith, Edinburgh, EH6 6QQ and online at www.legislation.gov.uk.
Mytilus trossulus is a species of mussel.
