34. In rule F5 (period during which injury pension was payable)(1)–
(a)for paragraph (1) (a), substitute–
“(a)(i)on retiring from a brigade before 2nd August 2005, or from employment with a fire and rescue authority before 6th April 2006, became entitled to an injury pension under rule B4 (as it existed before that date)(2); or
(ii)on retiring from employment with a fire and rescue authority on or after 6th April 2006, becomes entitled to an injury pension under the Compensation Scheme, and”; and
(b)in paragraph (1)(b), for “in the circumstances and within the period mentioned in rule K1(1) to(4) (cancellation of ill-health pension)”, substitute “following an offer of employment under rule K1A(2)(b),”.
Rule F5 was amended by article 2 of and paragraph 41 of the Schedule to S.S.I. 2005/566
Rule B4 is revoked by paragraph 7 of this Order.
