2.—(1) For the purposes of the Animal Health Act 1981 the value of an animal caused to be slaughtered by the Scottish Ministers because of foot-and-mouth disease shall be ascertained in accordance with this article.
(2) If the owner elects to have an animal valued by a valuer, the value, for the purpose of paragraph 3(2) of Schedule 3 to that Act, shall be the amount determined in writing by a valuer appointed jointly by the Scottish Ministers and the owner of the animal or, failing such appointment, by a valuer appointed by the President of the Institute of Auctioneers and Appraisers in Scotland.
(3) If the owner does not elect to have the animal valued by a valuer in accordance with paragraph (2) above, the value shall be the amount set out for that animal in the Schedule to this Order.
(4) The valuer shall be paid by the Scottish Ministers in respect of the expenses of that valuer incurred pursuant to this Order.
