The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2021(1) and all other powers enabling them to do so.

In accordance with section 7(2) of that Act, a draft of these Regulations has been laid before and approved by resolution of the Scottish Parliament.

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Budget (Scotland) Act 2021 Amendment Regulations 2022 and come into force on the day after the day on which they are made.

(2) In these Regulations, “the Act” means the Budget (Scotland) Act 2021.

Amendment of amounts specified in section 4

2.  In section 4 (overall cash authorisations) of the Act, for the amount specified in—

(a)subsection (2) (the Scottish Administration), substitute “£50,349,382,000”,

(b)subsection (3)(a) (the Scottish Parliamentary Corporate Body), substitute “£110,332,000”.

Amendment of schedule 1

3.—(1) The table in schedule 1 (the Scottish Administration) of the Act is amended in accordance with paragraphs (2) and (3).

(2) In column 1 (purposes)—

(a)in relation to purpose 2—

(i)after “other local authority” insert “revenue and”,

(ii)for “contracts to increase the resilience and capacity of third sector organisations” substitute “programmes to create the best conditions for the third sector and volunteering to thrive”,

(iii)omit “contributions and grants relating to regeneration; community-led regeneration; community engagement; community empowerment;”,

(b)in relation to purpose 3—

(i)after “central services” insert “, including procurement and e-commerce”,

(ii)after “Digital Strategy” insert “and economy”,

(iii)for “Growth Accelerator programme” substitute “Growth Accelerator and Green Growth Accelerator programmes”,

(iv)for “and technology grants” substitute “, innovation and technology/digital grants and support for low carbon economy”,

(v)after “broadband connectivity;” insert “contributions and grants relating to regeneration; community-led regeneration; community engagement; community empowerment;”,

(vi)after “South of Scotland Enterprise” insert “; support for inward trade and investment and exports”,

(c)in relation to purpose 4, after “local authorities;” insert “grant funding for the Scottish Credit and Qualifications Framework Partnership and Scottish Qualifications Authority accreditation;”,

(d)in relation to purpose 6—

(i)for “spend on waste prevention and management; costs relating to the United Kingdom’s withdrawal from the European Union” substitute “action to prevent waste, improve recycling, reduce emissions from waste, tackle litter and deliver a circular economy strategy;”,

(ii)for “heritage; environment” substitute “economy, including addressing biodiversity loss and peatland and nature restoration; environmental”,

(iii)after “Renewables Fund” insert “and Climate Justice Fund; funding for land reform and community ownership; Scottish Natural Heritage; the Scottish Environment Protection Agency; the National Park authorities; Royal Botanic Garden Edinburgh”,

(iv)for “the national forest estate; Green Growth Accelerator programmes” substitute “Scotland’s national forests and land”.

(3) In column 2 (amount of resources other than accruing resources), for the amount specified—

(a)in relation to purpose 1, substitute “18,398,353,000”,

(b)in relation to purpose 2, substitute “16,411,117,000”,

(c)in relation to purpose 3, substitute “2,615,955,000”,

(d)in relation to purpose 4, substitute “4,586,799,000”,

(e)in relation to purpose 5, substitute “3,123,485,000”,

(f)in relation to purpose 6, substitute “4,536,120,000”,

(g)in relation to purpose 8, substitute “947,680,000”,

(h)in relation to purpose 9, substitute “354,597,000”,

(i)in relation to purpose 11, substitute “71,642,000”,

(j)in relation to purpose 12, substitute “179,757,000”,

(k)in relation to purpose 13, substitute “61,090,000”,

(l)in relation to purpose 15, substitute “4,839,000”,

(m)in relation to purpose 16, substitute “178,556,000”,

(n)in relation to purpose 19, substitute “22,100,000”,

(o)in relation to purpose 20, substitute “6,026,759,000”,

(p)in relation to purpose 21, substitute “20,994,000”,

(q)in the final row, in relation to the total amount of resources, substitute “57,552,524,000”.

Amendment of schedule 2

4.—(1) The table in schedule 2 (direct-funded bodies) of the Act is amended in accordance with paragraph (2).

(2) In column 2 (amount of resources other than accruing resources), for the amount specified—

(a)in relation to purpose 1, substitute “127,709,000”,

(b)in relation to purpose 2, substitute “17,064,000”.

Amendment of schedule 3

5.—(1) The table in schedule 3 (borrowing by statutory bodies) of the Act is amended in accordance with paragraph (2).

(2) In column 2, for the amount specified in relation to enactment 4, substitute “240,000,000”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Budget (Scotland) Act 2021 (“the Act”).

Regulation 2 amends the overall cash authorisations specified in section 4(2) and (3)(a) of the Act in relation to the Scottish Administration and the Scottish Parliamentary Corporate Body.

Regulation 3(2) amends purposes 2, 3, 4 and 6 in schedule 1 of the Act, for which the Scottish Ministers may use resources in the financial year 2021/22.

Regulation 3(3) amends the amounts of resources other than accruing resources that may be used for purposes 1 to 6, 8, 9, 11 to 13, 15, 16 and 19 to 21 in schedule 1 of the Act. It also amends the total of amounts of resources for all the purposes in that schedule.

Regulation 4 amends the amounts of resources other than accruing resources that may be used for purposes 1 and 2 in schedule 2 of the Act.

Regulation 5 amends the amount of borrowing in relation to enactment 4 in schedule 3 of the Act.
