The Scottish Ministers make the following Order in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2014(1) and all other powers enabling them to do so.

In accordance with section 7(2) of that Act, a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Budget (Scotland) Act 2014 Amendment Order 2015 and comes into force on the day after the day on which it is made.

(2) In this Order, “the Act” means the Budget (Scotland) Act 2014.

Amendment of amounts specified in section 4 (overall cash authorisations)

2.  In section 4 of the Act, for the amount specified—

(a)in subsection (2) (Scottish Administration), substitute “£32,644,274,000”;

(b)in subsection (3)(a) (Forestry Commissioners), substitute “£58,935,000”; and

(c)in subsection (3)(c) (Scottish Parliamentary Corporate Body), substitute “£77,396,000”.

Amendment of schedule 1 (the Scottish Administration)

3.—(1) The table in schedule 1 to the Act is amended in accordance with paragraphs (2) to (4).

(2) In column 1 (purposes)—

(a)in relation to purpose 1, after “Culture” insert “, Europe”;

(b)in relation to purpose 2—

(i)for “Employment and Sustainable Growth” substitute “Constitution and Economy”;

(ii)for the words from “funding” to “standards” substitute “digital and broadband technology”;

(iii)after “enterprise-related activities;” insert “expenditure on corporate and central services; expenditure in relation to the running costs of the Office of the Chief Economic Adviser and the Office of the Chief Statistician; expenditure on Protocol; costs associated with referendums; expenditure on strategic communications with various audiences;”; and

(iv)after “Bankruptcy” insert “; provision for devolved taxes specified in Part 4A of the Scotland Act 1998, including collection and management”;

(c)in relation to purpose 3—

(i)for “Health and Wellbeing” substitute “Health, Wellbeing and Sport”; and

(ii)at the end, insert “; sportscotland; delivery and legacy of the 2014 Commonwealth Games.”;

(d)in relation to purpose 6, delete “; digital and broadband technology”;

(e)in relation to purpose 7—

(i)after “Works Commissioner;” insert “costs related to public enquiries;”;

(ii)delete the words from “housing subsidies” to “infrastructure”; and

(iii)delete the words from “expenditure on corporate” to the end;

(f)in relation to purpose 8—

(i)for “Local Government” substitute “Social Justice, Communities and Pensioners’ Rights”; and

(ii)after “emergencies” insert “; funding of strategic contracts to increase the resilience and capacity of third sector organisations; planning; architecture; building standards; housing subsidies and guarantees; Energy Assistance Package; Home Insulation Schemes; repayment of debt and any associated costs; other expenditure, contributions and grants relating to housing; activities relating to homelessness; research and publicity and other portfolio services; grants to local authorities and registered social landlords; loans to individuals; community engagement; regeneration programmes; grants for Vacant and Derelict Land Fund; loans to organisations; telecommunications infrastructure; funding of payments for welfare purposes; expenditure relating to equality issues”;

(g)omit purpose 16 (and the related entries in columns 2 and 3); and

(h)in relation in purpose 17, for “Training, Youth and Women’s Employment” substitute “Fair Work, Skills and Training”.

(3) In column 2 (amount of resources (other than accruing resources)), for the amount specified—

(a)in relation to purpose 1, substitute “194,239,000”;

(b)in relation to purpose 2, substitute “537,372,000”;

(c)in relation to purpose 3, substitute “12,355,658,000”;

(d)in relation to purpose 4, substitute “2,804,001,000”;

(e)in relation to purpose 5, substitute “2,573,517,000”;

(f)in relation to purpose 6, substitute “462,738,000”;

(g)in relation to purpose 7, substitute “2,251,963,000”;

(h)in relation to purpose 8, substitute “11,273,158,000”;

(i)in relation to purpose 9, substitute “3,617,272,000”;

(j)in relation to purpose 10, substitute “199,085,000”;

(k)in relation to purpose 11, substitute “20,927,000”;

(l)in relation to purpose 12, substitute “112,480,000”;

(m)in relation to purpose 13, substitute “74,491,000”;

(n)in relation to purpose 15, substitute “4,570,000”;

(o)in relation to purpose 17, substitute “252,402,000”; and

(p)in the final row, in relation to the total amounts of resources, substitute “36,736,873,000”.

(4) In column 3 (amount of accruing resources), for the amount specified—

(a)in relation to purpose 1, substitute “44,000,000”;

(b)in relation to purpose 8, substitute “20,000,000”;

(c)in relation to purpose 10, insert “24,600,000”;

(d)in relation to purpose 13, substitute “38,000,000”; and

(e)in the final row, in relation to the total amounts of resources, substitute “5,425,200,000”.

Amendment of schedule 2 (direct-funded bodies)

4.—(1) The table in schedule 2 to the Act is amended in accordance with paragraph (2).

(2) In column 2 (amount of resources other than accruing resources), for the amount specified—

(a)in relation to purpose 1, substitute “59,635,000”;

(b)in relation to purpose 2, substitute “10,930,000”;

(c)in relation to purpose 3, substitute “90,660,000”; and

(d)in relation to purpose 4, substitute “8,317,000”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Budget (Scotland) Act 2014 (“the Act”).

Article 2 amends the overall cash authorisations specified in section 4(2) and (3)(a) and (c) of the Act in relation to the Scottish Administration, the Forestry Commissioners and the Scottish Parliamentary Corporate Body.

Article 3(2) amends the purposes in purposes 1 to 3, 6 to 8, and 17 and omits purpose 16.

Article 3(3) amends the amount of resources (other than accruing resources) that may be used for purposes 1 to 13, 15 and 17 in schedule 1 to the Act. It also amends the total amount of those resources for all the purposes in that schedule.

Article 3(4) amends the amount of resources (accruing resources) that may be used for purpose purposes 1, 8 10 and 13 in schedule 1 to the Act. It also amends the total amount of those resources for all the purposes in that schedule.

Article 4 amends the amount of resources other than accruing resources that may be used by the direct-funded bodies for certain purposes in schedule 2 to the Act.

The Order reflects the reallocation of resources between Scottish Government portfolios following the First Minister’s announcement of the new portfolio structure on 21st November 2014.
