The Department of Agriculture, Environment and Rural Affairs(1) makes the following Regulations in exercise of the powers conferred on it by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972(2).
The Department has been designated(3) for the purposes of section 2(2) of the European Communities Act 1972 in respect of measures relating to the prevention, reduction and elimination of pollution caused by waste and in relation to the environment.
1. These Regulations may be cited as the Ship Recycling Facilities (Amendment) Regulations (Northern Ireland) 2018 and shall come into operation on 29th October 2018.
2. In the Ship Recycling Facilities Regulations (Northern Ireland) 2015(4), in regulation 2 (interpretation), in the definition of “the European List”, after “established” insert “and as amended from time to time”.

These Regulations are made in exercise of the powers in Section 2(2) of the European Communities Act 1972, in order to allow the amended provision to operate effectively.
The Department of the Environment was dissolved by section 1(9) of the Departments Act (Northern Ireland) >2016 (c. 5 N.I.) and, by virtue of Article 8(1)(c) of the Departments (Transfer of Functions) Order (Northern Ireland) 2016 (S.R. 2016 No. 76), its functions were transferred to the Department of Agriculture, Environment and Rural Affairs
