The Department of the Environment makes the following Regulations in exercise of the powers conferred by Articles 65(1) and 67(1)(m) of the Road Traffic (Northern Ireland) Order 1995(1).
1. These Regulations may be cited as the Goods Vehicles (Testing) (Amendment) Regulations (Northern Ireland) 2013 and shall come into operation on 30th September 2013.
2. In Schedule 2 to the Goods Vehicles (Testing) Regulations (Northern Ireland) 2003(2) (classes of vehicles to which these regulations do not apply) after item 40 add—
“41. Goods vehicles not exceeding 3,500 kilograms having a date of manufacture before 1st January 1960.”.

These Regulations amend Schedule 2 of the Goods Vehicles (Testing) Regulations (Northern Ireland) 2003 to allow goods vehicles not exceeding 3,500 kilograms manufactured before 1st January 1960 to be used on the roads without a vehicle test certificate. Article 4(2) of Directive 2009/40/EC (OJ L141, 6.6.2009, p.12) allows Member States to exempt such vehicles from roadworthiness testing.
