The Pensions (2008 Act) (Commencement No. 4) Order (Northern Ireland) 2012

The Department for Social Development makes the following Order in exercise of the powers conferred by section 21(1) of the Pensions Act (Northern Ireland) 2008(1).

Citation and interpretation

1.—(1) This Order may be cited as the Pensions (2008 Act) (Commencement No. 4) Order (Northern Ireland) 2012.

(2) In this Order “the Act” means the Pensions Act (Northern Ireland) 2008.

Appointed days

2.—(1) The day appointed for the coming into operation of—

(a)in Part 2 of Schedule 4 to the Act (abolition of contracting-out for defined contribution pension schemes: further amendments)—

(i)paragraph 45 in so far as it relates to paragraph 59, and

(ii)paragraph 59(2) in so far as it is not already in operation, and

(b)Part 7 of Schedule 6 to the Act (abolition of contracting-out for defined contribution pension schemes: further repeals) in so far as it relates to the repeal of the following provisions—

(i)in paragraph 2 of Schedule 3 to the Pension Schemes (Northern Ireland) Act 1993(3) in sub-paragraph (5) the definition of “appropriate flat-rate percentage”, and

(ii)Article 134(6)(a) of the Pensions (Northern Ireland) Order 1995(4),

is 7th June 2012.

(2) The day appointed for the coming into operation of Part 7 of Schedule 6 to the Act in so far as it relates to the repeal of Article 136 of the Pensions (Northern Ireland) Order 1995 is 6th April 2015.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation further amendments contained in the Pensions Act (Northern Ireland) 2008 (“the Act”) in consequence of the abolition of contracting-out of the state additional pension for defined contribution pension schemes from 6th April 2012. The Order brings into operation—

  • in so far as it is not already in operation, paragraph 59 of Schedule 4 to the Act, as amended by section 25 of the Pensions Act (Northern Ireland) 2012 (c. 3 (N.I.)), on 7th June 2012, and

  • certain consequential repeals in Part 7 of Schedule 6 to the Act on 7th June 2012 and 6th April 2015.

NOTE AS TO EARLIER COMMENCEMENT ORDERS

(This note is not part of the Order)

The following provisions of the Pensions Act (Northern Ireland) 2008 have been brought into operation by earlier commencement orders as from the dates shown.
