The Electricity (Single Wholesale Market) (2007 Order) (Commencement No. 2) Order (Northern Ireland) 2007

Explanatory Note

(This note is not part of the Order)

This Order provides for the coming into operation on 20th June 2007 of the following provisions of the Electricity (Single Wholesale Market) (Northern Ireland) Order 2007—

(a) Article 3 which provides the Department of Enterprise, Trade and Investment (“the Department”) following consultation with the Northern Ireland Authority for Utility Regulation (“the Authority”), or the Authority with the consent of the Department, with the power to modify licence conditions in connection with the Single Electricity Market (“SEM”).

(b) Article 4 which introduces a prohibition on the activity of SEM operator without a licence or exemption and provides for such licences and exemptions.

(c) Article 9 insofar as it provides for conferring functions on the Department and the Authority in relation to the SEM and Article 10 insofar as it creates exemptions from duties conferred on the Department and the Authority under Article 9.

(d) Article 12 and certain provisions of Schedule 4 which provide for a number of consequential amendments to the Electricity (Northern Ireland) Order 1992 and the Energy (Northern Ireland) Order 2003.
