The Health and Personal Social Services (Assessment of Resources) (Amendment) Regulations (Northern Ireland) 2007

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Health and Personal Social Services (Assessment of Resources) (Amendment) Regulations (Northern Ireland) 2007 and shall come into operation on 09 April 2007.

(2) In these Regulations “the principal regulations” means the Health and Personal Social Services (Assessment of Resources) Regulations (Northern Ireland) 1993(1).

Amendment of regulation 20 (capital limit) of the principal regulations

2.  In regulation 20(2) (capital limit) of the principal regulations for “£21,000” substitute “£21,500”.

Amendment of regulation 28(1) of the principal regulations

3.  In regulation 28(1)(3) (calculation of tariff income from capital) of the principal regulations

(a) for “£12,750” (both times it appears) substitute “£13,000”; and

(b) for “£21,000” substitute “£21,500”.

Amendment of Schedule 3 to the principal regulations

4.—(1) Part 1 of Schedule 3 to the principal regulations (sums to be disregarded in the calculation of income other than earnings)is amended in accordance with paragraphs (2) and (3)—

(2) For paragraph 27A(4) substitute—

“27A.— (1) Any child benefit, except in circumstances where a resident is accompanied by the child or qualifying young person in respect of whom the child benefit is payable and accommodation is provided for that child or young person under Article 15 or 16 of the Order(5)

(2) In this paragraph “child” and “qualifying young person” have the same meaning as in section 138 of the Contributions and Benefits Act(6).”

(3) In paragraph 27 (H)(7)

(a) In sub-paragraphs (1) and (2), for “£5.05” (each time it appears) substitute “£5.25”;

(b) In sub-paragraphs (3) and (4), for “£7.50” (each time it appears) substitute “£7.85”.
