Police Service of Northern Ireland and Police Service of Northern Ireland Reserve (Full-Time) (Severance) Amendment Regulations 2006

The Secretary of State makes the following Regulations in exercise of the powers conferred on him by section 25(2)(k) and section 26 of the Police (Northern Ireland) Act 1998(1).

In accordance with section 72(2A) of the Police (Northern Ireland) Act 1998(2) these Regulations are made with the agreement of the Treasury.

Citation and commencement

1.  These Regulations may be cited as the Police Service of Northern Ireland and Police Service of Northern Ireland Reserve (Full-Time) (Severance) Amendment Regulations 2006 and shall come into force on 27th February 2006.

The Police Service of Northern Ireland and Police Service of Northern Ireland Reserve (Full-Time) (Severance) Regulations 2003

2.  The Schedule to the Police Service of Northern Ireland and the Police Service of Northern Ireland Reserve (Full-Time) (Severance) Regulations 2003(3) (“the Schedule”) shall be amended in accordance with regulations 3 and 4.

Added Years and Payment in Lieu

3.—(1) Part I of the Schedule shall be amended as follows.

(2) In paragraph 1 for “not ACPO rank” substitute “of any rank other than a Chief Constable or Deputy Chief Constable”.

(3) In paragraph 2 for “ACPO” substitute “Chief Constable or Deputy Chief Constable”.

Severance Lump Sums

4.—(1) Part II of the Schedule shall be amended as follows.

(2) In paragraph 1(1) for “not of ACPO rank” substitute “of any rank other than Chief Constable or Deputy Chief Constable”.

(3) After table (c) (Compulsory Retirement age of 60) insert:

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the voluntary early retirement scheme (“the Scheme”) for the Police Service of Northern Ireland and the Police Service of Northern Ireland Reserve (Full-time).

The Scheme contained provisions for officers of the rank of Chief Constable, Deputy Chief Constable and Assistant Chief Constable, (“ACPO ranks”) in the Police Service of Northern Ireland, which differed to those for other ranks. This difference arose from the fact the ACPO ranks were employed on fixed term appointments of seven years at a time.

From 1st April 2004 the appointments were altered so as to introduce fixed term appointments of 5 years at a time for Chief Constable and Deputy Chief Constables, and a compulsory retirement age of 65 for Assistant Chief Constables.

These regulations amend the scheme so as to adjust the payments to the ACPO ranks to reflect their new appointment terms.
