The Department of the Environment, being a department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the prevention, reduction and elimination of pollution of water, in exercise of the powers conferred on it by that section and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Control of Asbestos in Water (Amendment) Regulations (Northern Ireland) 1996 and shall come into operation on 20th February 1997.
2. The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.
3. After regulation 4 of the Control of Asbestos in Water Regulations (Northern Ireland) 1995(4) there shall be inserted the following regulation—
4A.—(1) The Department shall ensure that measurements are taken, at regular intervals, of asbestos discharges (made in accordance with a consent granted under regulation 4(1)) into the aquatic environment.
(2) For the purpose of checking compliance with the limits specified in that consent the sampling and analysis procedures and methods shall be in conformity with those described in the Annex to the Directive or with any other procedure or method which gives equivalent results.”

These Regulations amend the Control of Asbestos in Water Regulations (Northern Ireland) 1995 which require the Department of the Environment (“the Department”) to reduce and prevent, as far as reasonably practicable, emissions of asbestos into the aquatic environment. The amendment requires the Department to monitor at regular intervals any discharge into the aquatic environment which may contain asbestos.
