14.—(1) In the transitionally protected period, the amount of a person’s earnings shall, for the purpose of determining a person’s entitlement to an amount of a contribution-based jobseeker’s allowance, be calculated or estimated in accordance with section 3 of the Benefits Act (earnings) and regulations 2 to 4 of the Social Security Benefit (Computation of Earnings) Regulations (Northern Ireland) 1978(1).
(2) In any case where—
(a)the amount of a person’s earnings are determined in accordance with provisions which applied before 7th October 1996 (“the old rules”), and
(b)the person’s earnings subsequently fall to be determined in accordance with the provisions of the Order and the regulations made thereunder (“the new rules”),
any earnings determined in accordance with the old rules shall be disregarded for the purposes of the new rules.
