22Hawl i asesiad

(1)Mae gan oedolyn hawl i asesiad fel a ddisgrifir yn adran 25–

(a)os yw'r oedolyn yn gwneud cais i'r naill neu'r llall o'r partneriaid iechyd meddwl lleol ar gyfer ardal yr awdurdod lleol y mae'r oedolyn fel arfer yn preswylio ynddi i gynnal asesiad o'r fath;

(b)os yw'r oedolyn wedi'i ryddhau o wasanaethau iechyd meddwl eilaidd (p'un a oedd y gwasanaethau yn gyfrifoldeb partner iechyd meddwl lleol y gwnaed y cais am asesiad iddo ai peidio);

(c)os gwneir y cais o fewn y cyfnod rhyddhau perthnasol (gweler adran 23); a

(d)os nad yw'r partner iechyd meddwl lleol y gwneir y cais iddo yn ystyried y cais yn flinderus neu'n wacsaw.

(2)At ddibenion is-adran (1)(b), mae oedolyn wedi'i ryddhau o wasanaethau iechyd meddwl eilaidd os darparwyd gwasanaeth neu wasanaethau iechyd meddwl eilaidd i'r oedolyn ond na ddarperir iddo bellach, am ba reswm bynnag, unrhyw wasanaeth iechyd meddwl eilaidd.

(3)Mae'r cyfeiriad at ryddhau oedolyn o wasanaeth iechyd meddwl eilaidd yn cynnwys rhyddhau a ddigwyddodd pan oedd yr oedolyn yn blentyn.
