47 Savings.U.K.

Nothing in this Act or in any order made thereunder shall—

(a)[F1affect the powers conferred on the [F2Secretary of State] under the M1Dockyard Ports Regulation Act 1865;]

(b)[F3[F4affect any right conferred by or in accordance with [F5 the electronic communications code on the operator of an electronic communications code network ] or any duty of any such operator under that code;]]

[F6(c)authorise or require any person—

(i)to carry out any work of alteration, improvement, repair, maintenance, demolition or removal on any works constructed or maintainable by a [F7river authority] or other drainage authority, or

(ii)to carry out any work on land on which the sowing or planting of vegetation is carried out or vegetation is maintained by a [F7river authority] or other drainage authority,

unless the [F7river authority or other] authority consents or the work is to be done by, or under a scheme prepared by, a coast protection board on which the [F7river authority or other] authority is represented and is to be carried out in the area of that coast protection board;]

[F6(c)authorise or require any person—

(i)to carry out any work of alteration, improvement, repair, maintenance, demolition or removal on any works constructed or maintainable [F8by the Environment Agency, the Natural Resources Body for Wales or an] internal drainage board, or]

(ii)to carry out any work on land on which the sowing or planting of vegetation is carried out or vegetation is maintained [F9by the Environment Agency, the Natural Resources Body for Wales or an] internal drainage board,

[F10unless the Environment Agency, the Natural Resources Body for Wales] or the internal drainage board consents or the work is done by, or under a scheme prepared by, a coast protection board [F11on which the Environment Agency, the Natural Resources Body for Wales or the internal drainage board is represented] and is to be carried out in the area of that coast protection board;

(d)[F12authorise or require any person to carry out any work or do anything in contravention of the [F13the Ancient Monuments and Archaeological Areas Act 1979]; or]

(e)authorise or require any person to carry out any work of alteration, improvement, repair, maintenance, demolition or removal on any works constructed for the drainage of agricultural land in Scotland, unless the Secretary of State consents.
