Amendment of the Safeguarding Board for Northern Ireland (Membership, Procedure, Functions and Committee) Regulations (Northern Ireland) 2012

2.—(1) The Safeguarding Board for Northern Ireland (Membership, Procedure, Functions and Committee) Regulations (Northern Ireland) 2012(1) are amended in accordance with paragraphs (2) to (5).

(2) In regulation 3 (Membership)—

(a)for paragraph (2)(a) substitute—

(a)from the Regional Health and Social Care Board—

(i)the Director or Assistant Director of Social Care and Children; and

(ii)a Designated Doctor for Safeguarding Children;;

(b)in paragraph (2)(b)(iii) after “Health” insert “or Assistant Director for Service Development and Screening”;

(c)for paragraph (2)(c) substitute—

(c)an Executive Director for Social Work or Assistant Director for Children’s Services from each of the following HSC trusts—

(i)the South Eastern HSC Trust;

(ii)the Southern HSC Trust;

(iii)the Northern HSC Trust;

(iv)the Western HSC Trust;;

(d)after paragraph (2)(c) insert—

(cc)an Executive Director of Social Work or Co-Director for Children’s Services from the Belfast HSC Trust;;

(e)in paragraph (2)(d) after “children” insert “or the Chief Superintendent for Public Protection”;

(f)in paragraph (2)(e) after “Director” insert “or Assistant Director”;

(g)in paragraph (2)(f) after “Executive” insert “or Director”;

(h)in paragraph (2)(i) after “Service” insert “or Assistant Director”;

(i)after paragraph (2) insert—

(3) For the purposes of paragraph (2)(a)(ii) a Designated Doctor for Safeguarding Children means a paediatrician designated by the Regional Health and Social Care Board to provide information, advice and assistance regarding the safeguarding of children..

(3) In Schedule 1 (Meetings and Proceedings of the Safeguarding Board)—

(a)at the beginning of paragraph 8(1) insert “Subject to paragraph (1A),”;

(b)after paragraph 8(1) insert—

(1A) In exceptional circumstances, where more than one third of the total membership declares an interest under paragraph 9 (Declaration of interest), the quorum requirement will be satisfied if two thirds (rounded up to a whole number) of the remaining members are present..

(4) In Schedule 3 (Meetings and proceedings of the Safeguarding Panels)—

(a)at the beginning of paragraph 7(1) insert “Subject to paragraph (1A),”;

(b)after paragraph 7(1) insert—

(1A) In exceptional circumstances, where more than one third of the total membership declares an interest under paragraph 8 (Declaration of interest), the quorum requirement will be satisfied if two thirds (rounded up to a whole number) of the remaining members are present..

(5) In Schedule 5 (Meetings and proceedings of the Case Management Review Panel)—

(a)at the beginning of paragraph 7(1) insert “ Subject to paragraph (1A),”;

(b)after paragraph 7(1) insert—

(1A) In exceptional circumstances, where more than one third of the total membership declares an interest under paragraph 8 (Declaration of interest), the quorum requirement will be satisfied if two thirds (rounded up to a whole number) of the remaining members are present..
