Whereas the council of the London borough of Sutton has applied to the Secretary of State for an order to be made under section 76 of the Road Traffic Act 1991(1) and the Secretary of State has consulted the Commissioner of Police of the Metropolis in accordance with section 76(2) of that Act:

NOW, the Secretary of State for Transport, in exercise of the powers conferred by section 76(1) and section 77(6) of the Road Traffic Act 1991 and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Road Traffic (Special Parking Area) (London Borough of Sutton) (Amendment No. 2) Order 1995 and shall come into force on 16th June 1995.

Interpretation

2.  In this Order, unless the context otherwise requires—

“the principal Order” means the Road Traffic (Special Parking Area) (London Borough of Sutton) Order 1994(2);

“the transferred areas” means the areas referred to in the Schedule to this Order; and

“the special parking area” means the special parking area designated by article 3(1) of the principal Order.

Amendment of the principal Order

3.—(1) The principal Order shall have effect as if the transferred areas were included in the special parking area.

(2) Article 4 (modification of the Road Traffic Regulation Act 1984) and article 5 (modification of the Road Traffic Act 1991) of the principal Order shall apply in relation to the transferred areas as they apply in relation to the special parking area and references in those articles to “the special parking area” and to “a special parking area” shall be taken to include the transferred areas.

THE SCHEDULE THE TRANSFERRED AREAS

The areas transferred from the county of Surrey and the district of Epsom to the London borough of Sutton and referred to in article 6(2) and (3) of the Greater London and Surrey (County and London Borough Boundaries) Order 1994(3).

Explanatory Note

(This note is not part of the Order)

This Order adds to the special parking area designated by the Road Traffic (Special Parking Area) (London Borough of Sutton) Order 1994 (“the principal Order”) certain areas which were transferred to that borough in pursuance of local government boundary changes. The modifications in the principal Order to specified provisions of the Road Traffic Regulation Act 1984 and the Road Traffic Act 1991 are applied in relation to the areas added to the special parking area.
