The Secretary of State for Transport, in exercise of the powers conferred by sections 7(6), 14(4), 23(5)(b) and 57 of the Vehicle Excise and Registration Act 1994(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment No.3) Regulations 1994 and shall come into force on 30th January 1995.

Interpretation

2.  In these Regulations “the principal regulations” means the Road Vehicles (Registration and Licensing) Regulations 1971(2).

Duplicate licences

3.  In regulation 6(1) of the principal regulations —

(a)for the words “If a licence issued in respect of a vehicle under these Regulations” there shall be substituted the words “If a vehicle licence or a trade licence”; and

(b)for “£5.50” there shall be substituted “£7”.

Trade plates

4.  In regulation 31 of the principal regulations —

(a)for the words “two additional trade plates” in the proviso to paragraph (1), there shall be substituted “an additional trade plate”; and

(b)for paragraph (3) there shall be substituted the following paragraphs—

(3) If any trade plate issued by the Secretary of State to the holder of a trade licence is lost, stolen, destoyed or materially damaged, the holder of the licence shall apply to the Secretary of State for the issue to him of a replacement set of trade plates and the Secretary of State, upon being satisified that any plate has been lost, stolen, destroyed or materially damaged and —

(a)upon receipt of all those trade plates which are still in the possession of the holder of the licence; and

(b)except where paragraph (3C) below applies, on payment of the fee prescribed by paragraph (3B) below,

shall issue a replacement set of trade plates to the holder of the licence.

(3A) If only that part of a trade plate which consists of a means whereby the trade licence may be fixed thereto is lost, stolen, destroyed or materially damaged, the holder of the licence shall apply to the Secretary of State for the issue to him of a replacement means of fixing the licence and, upon payment of the fee prescribed by paragraph (3B)(c) below, the Secretary of State shall issue such a replacement.

(3B) The fees payable under paragraphs (3) and (3A) above shall be —

(a)for a replacement set of trade plates comprising two plates, £13.50;

(b)for a replacement set of trade plates comprising three plates, £18; and

(c)for a replacement means of fixing a trade licence to a trade plate, £2.

(3C) No fee shall be payable under paragraph (3) above on account of the replacement of a trade plate, if the Secretary of State is satisfied that the plate has become illegible or the colour of the plate has been altered, whether by fading or by other means, otherwise than by reason of any act or omission of the licence holder.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Road Vehicles (Registration and Licensing) Regulations 1971. Regulation 6(1) (duplicate licences) of the 1971 Regulations is amended to make it clear that it applies to both vehicle and trade licences and the fee payable for the issue of a duplicate licence is increased from £5.50 to £7. The other amendments are to regulation 31 (trade plates). A motorcycle dealer is only entitled to one additional trade plate. If a trade plate is lost, stolen damaged or destroyed the whole set must be replaced. The fees for the issue of a duplicate set of trade plates are fixed at £13.50 for a set of two trade plates and £18 for a set of three. A fee of £2 is prescribed for the issue of a replacement holder for the display of a trade licence.
