The Scottish Ministers make the following Order in exercise of the powers conferred by section 10(3) of the Management of Offenders etc. (Scotland) Act 2005(1) and all other powers enabling them to do so.
1. This Order may be cited as the Management of Offenders etc. (Scotland) Act 2005 (Specification of Persons) Amendment Order 2015 and comes into force on 31st March 2016.
2. In the Schedule to the Management of Offenders etc. (Scotland) Act 2005 (Specification of Persons) Order 2007 (persons specified for the purposes of section 10(3) of the Management of Offenders etc. (Scotland) Act 2005)(2), in the entry relating to persons providing services to, or on behalf of, a responsible authority, after “(a)” insert “or (e)”.

Article 2 of this Order amends the Schedule to the Management of Offenders etc. (Scotland) Act 2005 (Specification of Persons) Order 2007 (“the 2007 Order”).
The Schedule to the 2007 Order specifies those persons, for the purposes of section 10(3) of the Management of Offenders etc. (Scotland) Act 2005, with whom the responsible authorities, as defined in section 10(7) of that Act, are required to co-operate in the establishment and implementation of arrangements for assessing and managing the risks posed in each local authority area by offenders falling within the categories of person set out in section 10(1) of that Act.
Article 2 of this Order amends that Schedule to include any person who provides services to, or on behalf of, a responsible authority in connection with the assessment and management of the risks posed by any person who has been convicted of an offence if, by reason of that conviction, the person is considered by the responsible authorities to be a person who may cause serious harm to the public at large.
