The Scottish Ministers make the following Order in exercise of the powers conferred by section 216(1) of the Education Reform Act 1988(1) and all other powers enabling them to do so.
1.—(1) This Order may be cited as the Education (Recognised Bodies) (Scotland) Order 2007 and comes into force on 1st January 2008.
(2) This Order extends to Scotland only.
2. The bodies listed in the Schedule to this Order comprise all those bodies which appear to the Scottish Ministers to be recognised bodies.
3. The Education (Recognised Bodies) Order 1999(2) and the Education (Recognised Bodies) Amendment (Scotland) Order 2005(3) are revoked.

This Order lists the name of all those bodies which appear to the Scottish Ministers to be recognised bodies for the purposes of section 214(2)(a) or (b) of the Education Reform Act 1988 (the “1988 Act”).
For these purposes, recognised bodies are:
(a)universities, colleges or other bodies which are authorised by Royal Charter or by or under Act of Parliament to grant degrees; or
(b)other bodies for the time being permitted by those bodies defined at paragraph (a) to act on their behalf in the granting of degrees.
Section 214 of the 1988 Act makes it an offence for any person to grant, offer to grant or issue any invitation relating to any award which is not a recognised award but which may be taken to be an award granted or to be granted by a United Kingdom institution and is either described as a degree or may reasonably be taken to be a degree.
“Recognised awards” includes awards granted or to be granted by a recognised body. Any body listed in this Order is conclusively presumed to be a recognised body for the purposes of section 214.
The Order updates and replaces the list of bodies contained in the Education (Recognised Bodies) Order 1999 (SI 1999/833) as amended by the Education (Recognised Bodies) Amendment (Scotland) Order 2005 (SSI 2005/591). This Order revokes the 1999 Order in respect of Scotland and the 2005 Amendment Order.
The Order adds a number of new bodies to the Schedule, as these bodies appear to the Scottish Ministers to fall within (a) or (b) above. It also includes a number of schools, colleges and institutes of the University of London which have been permitted by the University to award University of London degrees.
1988 c. 40. Relevant modifications to that Act are contained in the Scotland Act 1998 (Consequential Modifications) (No. 2) Order 1999, Schedule 2, paragraph 91 (S.I. 1999/1820). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
