The Scottish Ministers, in exercise of the powers conferred by section 21(2) and (3) of the Public Appointments and Public Bodies etc. (Scotland) Act 2003(1) hereby make the following Order:

Citation

1.  This Order may be cited as the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Commencement No. 1) Order 2003.

Commencement

2.—(1) The day appointed for the coming into force of–

(a) section 4(a) and (b);

(b) section 17, insofar as it relates to the provisions in schedule 4 specified in paragraph (c); and

(c) paragraphs 2, 4(a) and (b), 6, 10, 13, 17(b)(i) and (ii) of schedule 4,

of the Public Appointments and Public Bodies etc. (Scotland) Act 2003 is 31st May 2003.

(2) The day appointed for the coming into force of–

(a) sections 15 and 16;

(b) section 17 insofar as it relates to the provisions in schedule 4 specified in paragraph (c); and

(c) paragraph 17(c)(ii) of Schedule 4,

of the Public Appointments and Public Bodies etc. (Scotland) Act 2003 is 1st June 2003.

Explanatory Note

(This note does not form part of the Order)

The Public Appointments and Public Bodies etc. (Scotland) Act 2003 (“the Act”) received Royal Assent on 11th March 2003. Sections 18, 19, 20 and 21 came into force on Royal Assent.

This Order brings the provisions of sections 4(a) and (b) of the Act, which provide for the dissolution of the Ancient Monuments Board for Scotland and the Historic Buildings Council for Scotland, into force on 31st May 2003. It also brings into force the provisions of sections 15 and 16 of, and schedule 3 to, the Act which concern the establishment of a new body, the Historic Environment Advisory Council for Scotland on 1st June 2003.

This Order brings into force on either 31st May 2003 or 1st June 2003, as appropriate, those provisions in schedule 4 to the Act concerned with the Ancient Monuments Board for Scotland, the Historic Buildings Council for Scotland and the Historic Environment Advisory Council for Scotland.
