SCHEDULE 1 LOCAL AUTHORITY FUNCTIONS FOR THE PURPOSES OF PAYMENTS UNDER SECTION 13(1) OF THE 2002 ACT

The functions of local authorities under–

1.  Sections 4, 5A, 5B, 12, 12A, 12B, 12C, 13, 13A, 13B, 14 and 59 of the 1968 Act(1).

2.  Sections 1 and 2(1) of the Chronically Sick and Disabled Persons Act 1970(2).

3.  Section 8 of the Disabled Persons (Services, Consultation and Representation) Act 1986(3).

4.  Sections 47 and 48 of the National Assistance Act 1948(4).

5.  Section 3 of the Disabled Persons (Employment) Act 1958(5).

6.  Sections 7, 8, 9 and 11 of the Mental Health (Scotland) Act 1984(6).

7.  Section 10 of the Adults with Incapacity (Scotland) Act 2000(7).

8.  Sections 1 to 8 of Part I, Part II and Part XIII of the Housing (Scotland) Act 1987(8).

9.  Part 1 of the Housing (Scotland) Act 2001(9).

SCHEDULE 2 NHS BODIES' FUNCTIONS FOR THE PURPOSES OF PAYMENTS UNDER SECTION 14, JOINT WORKING UNDER SECTION 15 AND THE SCOTTISH MINISTERS DIRECTIONS UNDER SECTION 17 OF THE ACT

1.  Functions referred to in the following sections which are exercisable by NHS bodies–

• Sections 19(1), 25(1), 26(1), 27(1), 36, 37 and 45 of the 1978 Act.

2.  Functions of a National Health Service trust conferred by order made under section 12A(10), or by delegation under section 12AA(a)(11), of the 1978 Act.
