Regulation 3(1) Regulation 5(1) Regulation 13(2)
1. Functions referred to in the following sections which are exercisable by NHS bodies–
Sections 19(1), 25(1), 26(1), 27(1), 36, 37 and 45 of the 1978 Act.
2. Functions of a National Health Service trust conferred by order made under section 12A(10), or by delegation under section 12AA(a)(11), of the 1978 Act.

Section 12AA was inserted by section 47 of the Health Act 1999 (c. 8).
