The Scottish Ministers, in exercise of the powers conferred by article 30(1) of the Foot and Mouth Disease Order 1983(1), and of all other powers enabling them in that behalf, hereby make the following Order:
1.—(1) This Order may be cited as the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) Order 2001 and shall come into force on 23rd February 2001 at 6.15 p.m.
(2) This Order shall cease to have effect at midnight on 2nd March 2001.
(3) This Order extends to Scotland only.
2. The territory of Scotland is declared a controlled area to which the provisions of Part IV of the Foot-and-Mouth Disease Order 1983 apply as varied in accordance with, and disapplied to the extent set out in the Schedule to this Order.

Article 2
1. Articles 31, 32, 33, 34, 36(2), 36(3)(b) and 37 of Part IV of the Foot-and-Mouth Disease Order 1983 do not apply.
2. Part IV of the Foot-and-Mouth Disease Order 1983 is varied by the addition of the requirements set out in the following paragraphs:–
(a)no person shall move animals from the premises on which they are kept except under the authority of a licence issued by the Scottish Ministers;
(b)no person shall move any carcase (other than the carcase of an animal slaughtered for human consumption or a suspect BSE or scrapie carcase destined for disposal) except under the authority of a licence issued by the Scottish Ministers;
(c)no person shall move an animal into or out of the controlled area except under the authority of a licence issued by the Scottish Ministers;
(d)no person shall use any premises for fairs, markets, shows or other gatherings of animals;
(e)hunting and stalking are prohibited.
3. Licences under of Part IV of the Foot-and-Mouth Disease Order 1983 may only be issued by the Scottish Ministers.
4. The Scottish Ministers shall not commence consideration of applications for licences under this Part until they have been advised by the Chief Veterinary Officer that animal health conditions in the controlled area are such that licences may in some circumstances be issued.

This Order imposes, with variations, the restrictions contained in Part IV of the Foot-and Mouth Disease Order 1983 (S.I. 1983/1950, as amended) within Scotland.
S.I. 1983/1950, as amended by S.I. 1993/3119 and S.I. 1995/2922. See article 3(1) for the definition of “the Minister”. The functions of the Minister of Agriculture, Fisheries and Food so far as exercisable in relation to Scotland, were transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (c. 46)
