The Department of Finance and Personnel makes the following Regulations in exercise of the powers conferred by Article 30D of the Rates (Northern Ireland) Order 1977(1).
1. These Regulations may be cited as the Rate Relief (Energy Efficiency Homes Scheme) (Revocation and Savings) Regulations (Northern Ireland) 2011 and shall come into operation on 1st April 2011.
2. In these Regulations—
“the 2010 Regulations” means the Rate Relief (Energy Efficiency Homes Scheme) Regulations (Northern Ireland) 2010(2);
“application” means an application in such form and containing such information as the Department may reasonably require and such an application shall be deemed, for the purposes of the 2010 Regulations, to be an application made under regulation 6 of those Regulations; and
“application form” has the same meaning as in regulation 4(7)(e) of the 2010 Regulations.
3.—(1) Subject to paragraph (2), the 2010 Regulations are revoked.
(2) Without prejudice to section 28 of the Interpretation Act (Northern Ireland) 1954(3), the 2010 Regulations (apart from regulation 6) shall continue to have effect in a case where an application form has been requested from the Energy Saving Trust (“the Trust”) before 1st April 2011 and an application is subsequently made to the Trust before 1st July 2011.

These Regulations revoke, with savings, the Rate Relief (Energy Efficiency Homes Scheme) Regulations (Northern Ireland) 2010 which provided for rate relief for dwellings in respect of which owner-occupiers had made energy efficiency improvements to their home. Savings provisions are made for cases where an application form has been requested from the Energy Saving Trust before 1st April 2011 and an application is subsequently made to the Trust before 1st July 2011.
