ROAD TRAFFIC AND VEHICLES

Control of Traffic (Antrim) Order (Northern Ireland) 1996

Coming into operation

2nd September 1996

WHEREAS the Department of the Environment has published a notice in compliance with Article 23(1) and (2) of the Road Traffic (Northern Ireland) Order 1981(1);

AND WHEREAS two objections have been received and subsequently withdrawn and no representation has been received;

NOW THEREFORE the Department, in exercise of the powers conferred on it by Articles 21(1) and 22(1) of the Road Traffic (Northern Ireland) Order 1981 and of every other power enabling it in that behalf, and in relation to Article 22(1) being satisfied that the roads and length of road specified in Article 2 and Schedule 1 are unsuitable for unrestricted use by vehicles, makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Control of Traffic (Antrim) Order (Northern Ireland) 1996 and shall come into operation on 2nd September 1996.

(2) In this Order “taxi” means a public service vehicle used in standing or plying for hire and used to carry passengers for hire and being a vehicle seating not more than six passengers in addition to the driver.

Prohibition of traffic

2.  Subject to Article 3, the use by vehicles, other than taxis, of the roads and length of road specified in Schedule 1, is prohibited.

Exceptions

3.  Article 2 shall not apply to—

(a)a vehicle the driver of which is acting upon the direction or with the permission of a constable in uniform or of a traffic warden;

(b)a vehicle being used for police, military, ambulance or fire brigade purposes or in an emergency by a medical practitioner;

(c)a vehicle being used on or adjacent to the roads or length of road in pursuance of statutory powers or duties by or on behalf of a government department, district council or statutory undertaker;

(d)a vehicle being used in connection with the laying, erection, alteration or repair of any telecommunications apparatus as defined in section 4(3) of the Telecommunications Act 1984(2); or

(e)a vehicle being used in connection with any building operation or demolition on or adjacent to the roads or length of road.

Prohibition of direction of travel

4.  A person shall not, except upon the direction or with the permission of a constable in uniform or of a traffic warden, cause or permit any vehicle to proceed on the road or length of road specified in column 1 of Schedule 2 in a direction other than that specified in relation to that road in column 2.

Prohibition of right-hand turn

5.  Subject to Article 7, a person shall not—

(a)cause or permit a vehicle travelling in a westerly direction along the link road between Castle Street, Antrim, and Dublin Road to make a right-hand turn into Dublin Road between 8.00 a.m. and 9.30 a.m. and between 4.00 p.m. and 6.00 p.m.; and

(b)cause or permit—

(i)a vehicle other than a taxi at any time; and

(ii)a taxi between 8.00 a.m. and 9.30 a.m. and between 4.00 p.m. and 6.00 p.m.

travelling in a northerly direction along Dublin Road, Antrim, to make a right-hand turn into the access lane from Dublin Road to the link road referred to in paragraph (a).

Prohibition of U-turn

6.  Subject to Article 7, a person shall not cause or permit a vehicle travelling in a northerly direction along Dublin Road, Antrim, on reaching its junction with Castle Way, to make a U-turn at the northern end of the central reservation.

Exemptions

7.  Articles 5 and 6 shall not apply to—

(a)vehicles being used for fire brigade, ambulance, police or military purposes; or

(b)a vehicle, the driver of which is acting upon the direction or with the permission of a constable in uniform or of a traffic warden.

Article 2

SCHEDULE 1

1.  Castle Street, Antrim, from a point approximately 14 metres north of its junction with Market Square, to a point approximately 50 metres north of that junction.

2.  The link road between Castle Street, Antrim, and Dublin Road.

3.  The access lane from Dublin Road, Antrim, to the link road referred to in paragraph 2.

Explanatory Note

(This note is not part of the Order.)

This Order prohibits the use of the roads and length of road in Antrim specified in Schedule 1 by vehicles other than taxis. Exceptions include emergency vehicles, vehicles being used on or adjacent to the roads in pursuance of statutory powers or duties, vehicles being used in connection with telecommunications work, and vehicles being used in connection with any building operation or demolition on or adjacent to the roads.

The Order also—

1.  introduces a one-way traffic system in the access lane from Dublin Road, Antrim, to the link road between Castle Street and Dublin Road;

2.  introduces a one-way traffic system in the link road between Castle Street, Antrim, and Dublin Road, from its junction with the access lane to its junction with Dublin Road;

3.  prohibits vehicles travelling in a westerly direction along the link road between Castle Street, Antrim, and Dublin Road from making a right-hand turn into Dublin Road between 8.00 a.m. and 9.30 a.m. and between 4.00 p.m. and 6.00 p.m.;

4.  prohibits—

(a)vehicles other than taxis at any time; and

(b)taxis between 8.00 a.m. and 9.30 a.m. and between 4.00 p.m. and 6.00 p.m.

travelling in a northerly direction along Dublin Road, Antrim, from making a right-hand turn into the access lane from Dublin Road to the link road between Castle Street and Dublin Road; and

5.  prohibits vehicles travelling in a northerly direction along Dublin Road, Antrim, on reaching its junction with Castle Way, from making a U-turn at the northern end of the central reservation.

Any person who acts in contravention of the Order shall be guilty of an offence under the Road Traffic (Northern Ireland) Order 1981 and shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale (£1,000).

Traffic signs indicating the effect of the Order will in due course be erected on the roads.
