The Welsh Ministers, in exercise of the powers conferred upon them by sections 80(1)(b) and 187(1)(b) of the Regulation and Inspection of Social Care (Wales) Act 2016(1) (“the 2016 Act”), make the following Regulations.
In accordance with section 187(2)(n) of the 2016 Act, a draft of this instrument has been laid before, and approved by a resolution of, Senedd Cymru(2).
1.—(1) The title of these Regulations is the Social Care Wales (Specification of Social Care Workers) (Registration) (Amendment) Regulations 2025.
(2) These Regulations come into force on 1 April 2025.
2. In these Regulations “the 2016 Regulations” means the Social Care Wales (Specification of Social Care Workers) (Registration) Regulations 2016(3).
3. In regulation 2 (interpretation) of the 2016 Regulations, insert the following in the appropriate place—
““special school residential service” (“gwasanaeth preswyl ysgol arbennig”) has the same meaning as that given in regulation 2 of the Regulated Services (Special School Residential Services) (Wales) Regulations 2023(4);”.
4. Regulation 3 (specification of social care workers) of the 2016 Regulations is amended as follows—
(a)in paragraph (2)(b)—
(i)at the end of paragraph (iv) omit “or”;
(ii)at the end of paragraph (v) insert “or”;
(iii)after paragraph (v) insert—
“(vi)a special school residential service,”;
(b)in paragraph (2)(bb)—
(i)at the end of paragraph (iv) omit “or”;
(ii)at the end of paragraph (v) insert “or”;
(iii)after paragraph (v) insert—
“(vi)a special school residential service,”;

These Regulations amend the Social Care Wales (Specification of Social Care Workers) (Registration) Regulations 2016.
Section 80(1)(b) of the Regulation and Inspection of Social Care (Wales) Act 2016 requires Social Care Wales to keep a register of social care workers of such description as may be specified by the Welsh Ministers in regulations.
These Regulations specify an additional description of social care workers in respect of which Social Care Wales must keep a register, namely those who are employed (whether as an employee or a worker) or engaged under a contract for services to provide care and support to any person in Wales in connection with a special school residential service.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations. A copy can be obtained from the Department of Health and Social Services, Welsh Government, Cathays Park, Cardiff, CF10 3NQ and is published on www.gov.wales.
References in the 2016 Act to “the National Assembly for Wales” now have effect as references to Senedd Cymru by virtue of section 150A(2) of the Government of Wales Act 2006 (c. 32).
