Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Y Gorchymyn hwn yw’r ail orchymyn cychwyn a wnaed gan Weinidogion Cymru o dan Ddeddf Rhentu Cartrefi (Cymru) 2016 (dccc 1) (“y Ddeddf”).
Mae’r Ddeddf yn gwneud darpariaeth ynghylch tenantiaethau a thrwyddedau sy’n rhoi’r hawl i feddiannu annedd fel cartref, gan gynnwys darpariaeth sy’n sefydlu dau fath o gontract at ddiben rhentu cartrefi ac at ddibenion cysylltiedig.
Mae’r Ddeddf wedi ei diwygio gan Ddeddf Rhentu Cartrefi (Diwygio) (Cymru) 2021 (dsc 3).
Mae erthygl 2 o’r Gorchymyn hwn yn dwyn y Ddeddf i rym, i’r graddau nad yw eisoes mewn grym, ar 1 Rhagfyr 2022.
Er mwyn paratoi ar gyfer dyfodiad gweddill y Ddeddf i rym, mae 13 o offerynnau statudol o sylwedd wedi eu gwneud o dan ddarpariaethau galluogi amrywiol o fewn y Ddeddf. Mae 12 o’r offerynnau statudol hynny wedi eu gwneud ar y sail y byddant yn dod i rym ar y diwrnod y daw adran 239 o’r Ddeddf i rym.
Mae adran 38(1) o Ddeddf Deddfwriaeth (Cymru) 2019 (dccc 4) yn galluogi Gweinidogion Cymru i ddiwygio darpariaethau sy’n disgrifio dyddiad neu amser drwy gyfeirio at ddyfodiad deddfiad i rym, a hynny â’r gwir ddyddiad neu amser (unwaith y bydd yn hysbys).
Drwy arfer y pŵer hwnnw, mae erthyglau 3 i 15 yn diwygio’r 12 o offerynnau statudol i roi cyfeiriad at 1 Rhagfyr 2022 yn lle cyfeiriadau at y diwrnod y daw adran 239 o’r Ddeddf i rym.
