NODYN ESBONIADOL

Mae Rhan 2 o Ddeddf Addysg (Cymru) 2014 (“Deddf 2014”) yn gwneud darpariaeth mewn perthynas â Chyngor y Gweithlu Addysg (“y Cyngor”).

Mae Rheoliadau Cyngor y Gweithlu Addysg (Prif Swyddogaethau) (Cymru) 2015 (“Rheoliadau 2015”) yn gwneud darpariaeth mewn perthynas â nifer o swyddogaethau’r Cyngor. Mae’r Rheoliadau hyn yn diwygio Rheoliadau 2015 er mwyn mewnosod Rhan 3A newydd. Mae’r Rhan 3A newydd yn darparu na chaniateir i weithwyr cymorth dysgu mewn ysgolion ddarparu’r gwasanaethau a nodir yn y Rhan 3A honno oni bai eu bod yn bodloni’r meini prawf penodedig. Mae’r meini prawf penodedig yn cynnwys bod yn gofrestredig â’r Cyngor yn y gofrestr a gynhelir ganddo yn unol ag adran 9 o Ddeddf 2014 (rheoliad 2(a) ac (c) o’r Rheoliadau hyn).

Mae rheoliad 2(b) o’r Rheoliadau hyn yn diwygio Rheoliadau 2015 i egluro bod rhaid i athrawon cymwysedig fod wedi eu cofrestru yn y categori cofrestru athro neu athrawes ysgol er mwyn iddynt allu cyflawni’r gwaith a bennir yn rheoliad 17 o’r Rheoliadau.

Mae’r Rheoliadau hyn yn diwygio Rheoliadau 2015 ymhellach er mwyn mewnosod Rhan 4A newydd. Mae’r Rhan 4A newydd yn darparu na chaiff gweithiwr cymorth dysgu mewn addysg bellach ddarparu’r gwasanaethau a nodir yn adran 16(2) o Ddeddf 2014 oni bai bod y person hwnnw wedi ei gofrestru â’r Cyngor yn y gofrestr a gynhelir ganddo yn unol ag adran 9 o Ddeddf 2014 (rheoliad 2(d) o’r Rheoliadau hyn).

Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
