Nodyn Esboniadol

Mae'r Rheoliadau hyn yn dirymu ac yn disodli'r wyth set o Reoliadau a bennir yn rheoliad 43.

Maent yn sefydlu system ar gyfer y fasnach mewn anifeiliaid byw a deunydd genetig rhwng Aelod-wladwriaethau (Rhan 2) ac ar gyfer mewnforio anifeiliaid byw, deunydd genetig a chynhyrchion sy'n dod o anifeiliaid, o'r tu allan i'r Undeb Ewropeaidd (Rhan 3).

Mae deddfwriaeth yr Undeb Ewropeaidd y mae'n ofynnol i gydymffurfio â hi, cyn y gall anifeiliaid neu nwyddau gael eu rhyddhau o reolaeth yn y porthladd mewnforio (yr “arolygfa ffin”), wedi ei rhestru yn Atodlen 1.

Fel cynt, mae Gweinidogion Cymru wedi eu galluogi (yn Rhan 4) i wahardd mewnforio unrhyw anifail neu gynnyrch i mewn i Gymru, os digwydd bod brigiad clefyd y tu allan i'r Deyrnas Unedig.

Gorfodir y Rheoliadau hyn gan Weinidogion Cymru, awdurdodau iechyd porthladd, awdurdodau lleol ac Asiantaeth Ffiniau'r Deyrnas Unedig, yn yr amgylchiadau a geir yn rheoliad 32.

Mae'r Rheoliadau yn sefydlu tramgwyddau amrywiol, y gellid eu cosbi ar gollfarn ddiannod, drwy ddirwy hyd at yr uchafswm statudol, neu ar gollfarn drwy dditiad, gan ddirwy heb derfyn (neu, yn achos datgeliad mewn perthynas â gwybodaeth y tollau, carchariad o gyfnod hyd at dri mis).

Ni pharatowyd asesiad effaith rheoleiddiol ar gyfer yr offeryn hwn, oherwydd na ragwelir unrhyw effaith newydd ar y sectorau preifat, gwirfoddol na chyhoeddus.
